This operational audit and the data it contains show that the homeless shelter system is at this time a travel agency which assist the clients to travel up to 20,000 miles a year to seek services in other communities.

The system is a serious challenge to the United States Supreme Court Constitional Law on the Right of Citizens to Interstate Travel comprised by 100 some odd rulings incuding such precedents as US V Guest (383 U.S. 745 (more) 86 S. Ct. 1170; 16 L. Ed. 2d 239) and Williams V Fears 179 U.S. 270 (1900) The gist of the Supreme Court Law is that citizens have a well established right to engaged in interstate travel and live where they so wish. Generally it is beyound the power of the federal, state, or city governments to restrict these rights.

The operation of the homeless shelter network is a travel agency which effectively moves tens of thousands of clients back and forth across the United States each year. This year I am using the movement of the system to support my research in social services and emergency management

Mission apparently retaliates against Mike Kiffin a veteran who wanted to work with me as a partner in CHAPS-Mike told bye-bye. Mike is being denied access to FEMA vended USDA commodities programs vended through the mission. The outside temperature is in the 20's with slight snow and sleet. The actions of the mission staff are to cause injury or death of climate as result of lack of shelter in cold climate. Finally the Mission Director Tom Zobel puts in an appearance and denies Chris Walters services forever. After making history Dan apparently plans to become a permanent parasite who will suck on the church for the rest of his life where is still hangs out 10 years later.

June 1993-July 1993 Dallas, Texas: State of Texas exrel Walters BNO93054616: Title 18 USCS 241 Civil rights Hitchikes into Dallas and arrived in driving rainstorm. Asked to stay in Rescue Mission as better option than drowning. Mission staff explains they must hold my property and I make the mistake of explaining my electronic computer equipment is valuable. They tell me to sleep on chapel floor and keep my identification and property. The next morning I have to fist fight 3 mission staff to get out front door with my property. The only reason I did not get stomped was that the fight attracted attention of transients who did not like what was going on. The houseman said let him up and let him go.

Arrested by Officer Pork Chop: I am sitting on the bus bench some blocks away about half house later when City of Dallas Police car stops. The male officer states my name is Curtis and said that is the book you stole from the rescue mission and explains I am arrested. The female officer examines the book the says it is a book of letters from various governors, senators... addressed to me. The male officer ask me if I understand my rights. I explain I do not. He ask me what it is I don't understand and I ask him if he intends to prosecute me for stealing something I own? He replies he does not have time to be bothered to provide me with legal counsel because of an important breakfast engagement. He goes on to state that the mission frequently steals from guest and it is the policy of the City that they have the right to rob clients. After being charged with Burglar the charges are dropped to criminal trespass, and finally all charges are dropped and 7-3-93 we leave our happy home. The jail is actually nicer than most shelters I have seen.

October 6-8 93 Salem, Oregon: Oregon State Attorney General Office explains they will have sex with any USDC attempting to examine their records from California.

Interview with HUD Homeless Coordiator ("DA Mafia") in Portland,Oregon. Mark states he has had it with homeless people who "snivel". Mark states he recieves a never ending series of complaints from homeless who are sniveling about this and that. Mark goes on for about 10 minutes on this subject. I provide Mark copy of Complaint filed Walters v. Espy USDC-EDC and a brief on why cause involves Oregon and his venue. Advise Mark I am no longer doing CHAPS database.

Life continues at the Share House who states we will help you find work as can be done once each year. 10-29-93 I get a day work with security guard company until I get canned for not having an automobile. Mom sends money into Portland to assist this effort. Well mom we tried. Application for work Manpower-Vancouver, Kelley Temps;Montgomery Wards at Jantzen Beach.

November 93 Roseburg, OR; Rescue Mission welcomes me back and I spent a few weeks on here working as a volunteer at rescue mission. These folks are friendly, but this is a depressed area and if I want to try for work it is not here there is no vacation in Roseburg. Mom sends money for help me survive and food stamp folks are friendly. Onward we go in search of work. I get letter from Mission Staff when the lady in office is off duty. Mary has been sitting on my mail for a while. Are you stealing my mail? City of Roseburg buys last computer disc on emergency management.

Hi ho, hi ho over the mountain we go into the State of California. I have explained to mom I can get "welfare"; hundreds of dollars for the asking. Well Redding, CA explains we will give you about $119.00 a month if you search for work; but nobody in town has a message phone, oh well. On arriving in Chico, CA I visit my friend Warren Smith at the National Guard Armory and stayed until about December 20, 1993. Mom wired me $40.00 for shoes and then sent $100.00 for XMAS. I filed a Notice of Withdrawl from USDC in Walters V. Espy explaining neither Chris Walters, Mike Espy, nor the Court needed to be subjected to any further abuse. What is that you say Warren there is no place to receive messages for job search purposes here in town; everything is closing for Christmas; and I can remain here and get rained on. Ok I got the message.

Thank you for your letter to the Deputy Administrator concerning the Food Stamp Program. Your letter has been referred to us for response.

You stated that some State agencies refused to close your food stamp case. We assume that you wanted your food stamp cases closed because you moved from one place to another. Households are to report changes of residence and certain other changes to their local food stamp office within 10 days of the date the change becomes known to the household. Therefore, if you did report your change of residence as soon as you knew you were going to move, it appears that the food stamp office would have closed your food stamp case for you. Additionally, within certain exceptions, individuals must be living in the project areas where they apply for food stamps and cannot receive food stamps in more than one project area in any month.

Under the Food Stamp Act of 1977, as amended, the Food Stamp Progam operates under Federal rules that are basically the same everywhere in the country. The law makes State Agencies and their local offices responsible for the day-to-day activities of the program. Therefore, if you reported to your local food stamp office that you were going to move and your case was not closed, you may want to contact someone at the State level food stamp office. You also stated California, Oregon, and Washington only open cases for homeless applicants for 2 months at a time, while Arizona and Texas allow a much longer period. You imply that this violates the requirements of Sec. 5 (2014) (b) of the Food Stamp Act that there be uniform national standards of eligibility. The Food Stamp Program does have uniform national standards of eligibility. That does not mean, however, that each State agency must run the program in exactly the same way as every other State agency.

We have checked with our regional offices that oversee the States you mentioned. They have informed us that the certification periods for homeless households in those States are as follows: Arizona--from 2 to 6 months; California--2 to 12 months; Nevada--at least 6 months; Oregon-- 1 to 12 months; Texas --3 to 6 months; and Washington--2 to 12 months.

Under the Food Stamp Act, the Secretary of Agriculture has issued rules on certification periods. State agencies must follow these rules. The rule on length of certification periods is found at 7 CRF 273,10(F)(4). It states that State agencies must assign the longest certification period possible in view of the household's circumstances. This decision will not be the same in each decision on a certification period, even though the circumstances may appear similar to the household involved.
