Dear Judge McCoy:

I will not be able to attend my hearing on 6-22-1999 in San Antonio, Texas however have delivered earlier this year to your office:

1. 30 doctor reports-on my medical condition with letter-Certified mail and reciept signed by clerk at your address.

2. Motion to Strike Florida findings... stamped received by SSI office.

3. Various documents from Walters v. Apfel showing removal of questions of frauds to USDC in their own proper venues and a motion showing Defendant request for extension of time awaiting access to SSI records at your hearing....

4. As medical records were lost, stolen, or throw away in past I have mounted my medical records and case history on the internet at:

The 30 doctors reports contain statements of disability for long term GI problems believed by some authorities to be a "stricture of decending colon" which requires treatment by clindex or librax. Disability which is believed to be hereditiry involves chronic loss of bowel control, frequent need to remain near bathroom, and infectious process which can be spread to other persons through hand contact. Dr. Wright GI specialist in Kerrville, TX suggested the process is disabiling although would not commit his opinion to writting but did request complete GI series which estimated cost of about $3,000.00 doctor and hospital costs and $1,000.00 extras.

Various other doctor reports concern surgery for tumors and "melanoma" and freezing of about 50 sites with specific instruction by Dr. Posey to "stay out of sun" to avoid increased risk to additional cancer. Problems with cancer limit possible employment to activities occuring inside of building. Problems with cancer are also believed to be passed from generation to generation with many previous family members dying early due to terminal cancers.

Chris Walters submits from the record that SSI officials erred in holding hearings in Florida 2 months after they were notified Chris Walters moved out of Florida. Chris Walters also submits that SSI officials erred in moving the SSI claim to Stockton, CA in 1998 where Chris Walters did not reside after throwing away medical records which were previously signed for by SSA. California could only deny the reconsideration because medical records were missing.

Medical Insurance from Starmark Insurance was canceled as did Blue Cross and Blue Shield which felt I represent an unacceptable medical risk. Although I have not worked gainfully since 1983 I did inherit some money this year and started a small desktop publishing company which may or maynot eventually demonstrate employability even while disabled. Based on past experience I would have to submit that the disability is not treatable or workable while homeless (due to lack of income). While it cost an estimated $10,000.00 a year to support Chris Walters as a homeless person the chances of employment occuring or taxes being paid are zero. A finding of disability and award of SSI a small income, and medical benefits.... might provide society and Chris Walters recourse for eventual employment who knows maybe even effective treatment for the GI disorder.

Dear Judge McCoy:

I spoke to your staff assistant Tina today and inquired wheather you had received the bound express mail document for the hearing which left Corvallis, OR last Thursday which hopefully have not been seized or stole by government officials( Copy of cover letter enclosed). In requesting an Administrative Law Hearing last September I indicated I would not appear in person and again earlier this year had communicate by certified US mail with return reciept that I would not appear in person because the the legal precedent set in the USDC, WDT. Walters v David Miller SSI Inspector General USDC-WDT TX 97-CV-1313 ask wheather the government was suffering from loss of substantial rights in this cause because of frauds, hoaxes, and sham for instance hearings held in 2 states where I did not reside and destruction or loss of 30 doctors report which were not mentioned in Denial of Reconsideration(which have been resubmitted). Judge Fred Biery responding to pleadings by Texas Assistant Attorney General Morgan and US Attorney dismissed the Amicus Curiea and provides no legal remedy for the experts from the SSA to make up for lost rights during an Administrative Law Hearing. I appealed to 5th US Circuit Court of Appeals 99-50174 which found the appeal was late and the US Supreme Court deferred a ruling on Petition For Writ of Certiorari.

Walters v. Apfel CA99-156SS Before USDC Judge Sam Spade USDC, Austin and Walters v. Apfel CA 99cv0668 Before Judge Robertson in USDC Washington,D.C are civil rights actions seeking damages for civil rights violations.

Discussion

The Social Security Administration has won a legal precedent which makes no provision for it's experts too appear at an Administrative Law Hearing and make up for substantial rights it voluntarily forfietted during the Initial Application or Reconsideration. It is not the place of the Administrative Law Judge nor Chris Walters to circumvent the rulings of the USDC, 5th Circuit Court of Appeals, or Supreme Court during the Administrative Law Hearing. Chris Walters has resubmitted reports from 30 medical doctors on his disability, and related documents and has exercised his legal right to not appear in person for the hearing but let the Administrative Law Judge rule on the records at hand.
