HAIRBOOK LICENSING EXEMPTIONS

Howdy my name is Chris Walters and I understand you had some questions about Hairbook's licensing exemptions. Hairbook is a wholly owned subsidiary & licensed interstate reference book publishing company whose hair and fashion books are published on the internet. We charge a modeling fee and there is not cost for our haircuts and styles which are done incidentally to production and sales of CD's and motion pictures.

Administrative Order Of State District Court

The Honorable Bexar County State District Court Judge James Onion has issued an administrative Law Order in Walters v Aguirrie (Texas State Board of Cosmetology circia 1978-79) exempting Chris Walters and the salon Shear Shack 722 1/2 Woodland, SA, TX 78222 from licensing or supervision by the Texas Cosmetology Board because of a lack of Texas State jurisdiction. The ruling apparently later became part of the Texas State Codes:

Texas Codes Exemption From Licensing

1. 8451 Section 39(a)

Sec. 39. Exemptions.

(b) A person who provides incidental cosmetology services or who owns, operates, or manages the location at which those services are provided is exempt from the requirements of this Act if the primary purpose of the services is to enable or assist the recipient of the services to participate as the subject of:

(1) a photographic sitting at a fashion photography studio;

(2) a television appearance; or

(3) the filming of a motion picture.

Oregon, Washington, California Exemptions From Licensing

Oregon: ORS 690.025 Exemptions:This chapter does not apply to:

(1) Persons who perform service without compensation in case of emergency or in domestic administration.

(6) Persons applying temporary makeup, combing hair or applying hair spray, without compensation specifically for the application or combing, for the sole purpose of preparing any individual for a professional photograph or theatrical performance.

Washington: RCW 18.16.070 Licensing -- Persons to whom chapter inapplicable. This chapter shall not apply to persons licensed under other laws of this state who are performing services within their authorized scope of practice and shall not be construed to require a license for students enrolled in a school.

California: Chapter 10, Division 3 7319(c)(d)

The following persons are exempt from this chapter:

(c) Persons employed to render barbering, cosmetology, or electrolysis services in the course of and incidental to the business of employers engaged in the theatrical, radio, television or motion picture production industry.

(d) Persons engaged in any practice within its scope when done outside of a licensed establishment, without compensation.
