NOW COMES THE Plaintiff Pro Se Chris Walters aka Special Defender on Human Rights to the Honorable United States District Court for the Southern District of New York to wit:

Title 28 USC 1330 Actions against foreign states provides a US District Court jurisdiction for action at bar while the United Nations jurisdiction to receive information under the 1503 Process creates a jurisdiction for persons known as "special defenders" to communicate with various elements of the UN Human Rights Council or UN High Commission on Human Rights

1. Chris Walters moves to enter this Amicus Curiae Brief as an honorary field investigator for several US Government programs and Special Rapporteur to United Nations High Commission On Human Rights seeks to file this 1503 Report with the appropriate parties at the UN Human Rights Council and International Court of Justice.

2. Exhibit A: 11 US Judges and 3 US Circuit Courts of Appeals have ruled that the only place questions concerning Chris Walters SSI claim can be considered is when the Commissioner of Social Security files a timely action pursuant to Title 42 USC 405 (g)(H) Judicial Review

3. Although Chris Walters has no right to otherwise vend, dispense, or practice law in SSI law over the last 20 years we have many public and private interest attempting to question the rule of law who have generated hundreds of megabytes of data over the last 20 years as cited in the Exhibit C the CD Rom submitted as Evidence and Testimony to Congress Exhibit C.

4. Aside from massive violations of Title 18 USC 1509 Obstruction of Court ORDER and violations of Title 18 USC 402 Contempt the various 3rd partieshave demanded Chris Walters a person with cancer �slap a cop to get food stamps�;called across sections of the US asking to have Chris Walters denied treatment for cancer; denied treatment for blood clots; and other ailments and committed other actions which easily violate the United Nations Treaties on Human Rights and Genocide as cited in #7.

1. Plaintiff pro se Chris Walters was checking the Court docket on line to see if the �Notice Plaintiff Survived Minor Assassination Attempt Sorry For Delay of Proceedings� and noted that the Court reversed Docket #4 ORDER granting INF and entered ORDER OF Dismissal dated August 8th, 2012.

2. Chris Walters wishes to thank the Court for it�s ruling and asks the Court to noted that Chris Walters has already been given permission to proceed as AD HOC counsel to UN in 1999 without objection of either US Department of Justice or any of the Courts which can be reviewed on line:

4. The International 1503 Treaty establishes �Special Defenders� or observers who file reports largely as a matter of formality and as in the case at bar the conversation assigns a case number for reference and there is little likely hood that UN officials do anything of substance.

In creating a long term neutral venue until the questions could be returned to various Congressional Committees it was presumed that the UN High Commission on Human Rights would be an ideal obscure outpost. As one of the most obscure and inept organizations on the face of the planet the UNHCHR is totally void of the ability to enforce or even receive substantial human rights complaints anywhere on the face of the planet. A question of law on the constitutionality of the Federal Rules of Civil Procedure has arisen in several actions in USDC most recently in Walters V Ocampo, Lassierre 12-cv-4857,� USDC, SDNY the Honorable Chief Judge Loretta Preska presiding. The purpose of this brief is not to question the right of a Federal Judge to dismiss a cause for lack of jurisdiction; or to recuse themselves; but rather revolves around assassination attempts and acts of terrorism directed against Plaintiffs in various USDC proceedings which have been noted over the last 25 years. Question of Impeachment of USDC Chief Judge Loretta Preska et all?

1. The Court Docket Item #3 shows Chris Walters was given to proceed with an informational Amicus Curiae authorized by the Court on 6/20/2012.

2. On August 1st, 2012 Chris Walters sought to file Notice Plaintiff Survives Minor Assassination Attempt-Sorry for Delay of Proceedings which Exhibit A the enclosed envelope returned by the Court shows it the Court stamped it received on August 4th, 2012 and again on August 7th, 2012.

3. On August 5th, 2012 the Honorable Chief Judge Loretta Preska entered an ORDER and Finding that the cause of action was frivolous and Dismissed with Prejudice which are docketed #5-6 on August 7th, 2012.

4. The question at hand asks if the Court aided and abetted an assignation attempt against one of the Plaintiff occurring in or near the litigation and if so does this challenge the Constitutionality of Federal Rules of Civil Procedure based on Command of the US Supreme Court Precedents concerning the equal protection and due process of the law:

1. Fundamental request of due process is opportunity to be heard at a meaningful time and in meaningful manner. Matthews v. Eldridge VA 1976 96 S.Ct 893, 424 US 319. 47 L.Ed.2d.18

Exhibit C contains citations that the �Renaissance Committee of San Diego, Ca acting as representatives of the US Department of HUD state their programs killed so many clients they couldn�t botherd to report them in the newspaper and those who died got what they deserved. Should the Honorable USDC Judge Loretta Preska be considered an active and willing accessory to premeditated Genocide or simply unfit to hold office?

On July 24th, 2012, The Honorable Chief Judge Loretta A Preska entered an ORDER granting Chris Walters the right to proceed as an Amicus Curiae to provide information to various UN Officials under the 1503 Treaty as already has been authorized in 1996 by the several US Courts

Exhibit A The action at law filed in the case at bar is an Amicus Curiae yearly report on human rights violations, possible genocide, multiple assassination attempts against counsel of record�which Counsel explained could be filed electronically and Chris Walters due to physically disability cannot even attend hearings� According to Court Docket #3 dated 7-14-2012 shows Chief Judge Loretta Preska ORDERED the cause filed in forma pauperis without payment of fees .

Exhibit B Notice Plaintiff Survives Minor Assassination Attempt-Sorry For Delay of Proceedings, and Exhibits mailed to USDC Civil Filing Clerk: by First Class US Mail 10 US Stamps on August 2, 2012 from downtown Harrisburg, PA. Court Docket #4 dated 8/7/2012 states permission to proceed in forma pauper is denied and Chief Judge Loretta Preska is denying Chris Walters case as frivolous with no mention in the docket of Chris Walters pleading that he survived a minor assassination attempt.

Assassination of counsel before a USDC where the Judge does not even cite the event or place it in the docket would seem to fly in the face of the Federal Rules of Civil Procedure and might even draw into question the constitutionality of the FRCP. That Chief Judge Loretta Preska�s ORDER and ruling states she cannot clearly understand the implications of genocide, crimes against humanity, and past history of assassination of counsel is after all a complex series of questions in International law and what fault could be laid on this aspect of the case? Chief Judge Loretta Preska�s ruling explains with several precedents that Chris cannot act as counsel of record or a Special Defender providing technical assistance to a UN Organ.

1 Exactly how a Chief Judge can overrule, Quash, or overturn a 15 year old ruling from a US Circuit Court of Appeals without challenging the Federal Rules of Appellate Procedure is unknown. Can a USDC Judge over turn the decision of a 3 Judge US Circuit Court of Appeals which the Supreme Court has declined to review? Some of the irregularities in the case at bar closely resemble events in Walters v Asture Case 1:11-cv-000359-LMB USDC, Idaho where a self professed Texas terrorist Dain Kunzler appeared over the rule of the Court and demanded a right to tamper with and interfere with the parties:

Retired US Supreme Court Justice John Paul Stevens recently suggested should the normal fair and impartial administration of law here in the United States be captive to everyone who donates money to a political cause? Retired U.S. Supreme Court Justice John Paul Stevens said his former colleagues may be having�second thoughts� about the reach of the 2010 ruling that let corporations spend unlimited sums on political campaigns.

If something irregular is noted by the 2nd US Circuit Court of Appeals the Court might consider the current political patronage systems permits 3rd parties to make donations to politicians and we have major politicians publically stating they want to put term limits on federal judges; have Congress over rule the Supreme Court. A political interest who might wish to influence the Honorable Chief Judge Loretta Preska�s decision would have a definite problem with Chris Walters activities; reports; simply because they cannot be forced to comply with the political agenda of any political party-which was the point of removing the questions to the neutral venue of the UN in the first place.

While this Judicial Disability question is not an appeal the 2nd Circuit Court of Appeals might ask if we allow persons to attempt to assassinate plaintiffs engaged in litigation in or near the court at what point do we whack say US Attorneys; US Magistrates; or Federal Judges. In the determination of any criminal charge against him, or of his rights and obligations in a suit at law, everyone shall be entitled to a fair and public hearing by a competent, independent and impartial tribunal established by law.

1. Exhibit A: on September 12th, 2012 the clerk of the United States knowing that a Judicial Conduct proceeding was in progress mailed what appears to be a critical piece of evidence to Chris Walters instead of to the Clerk of 2nd US Circuit Court of Appeals.

2. Exhibit A is an exhibit giving Notice that Plaintiff Chris Walters had survived a minor assassination attempt.

3. Exhibit B: is the envelope it arrived in which has been stamped on August 4th, 2012 and again on August 7th, 2012.

4. The envelope contradicts the Court docket showing that the item arrived before the Court issued it�s Order and Finding Exhibit C cited as August 4th, 2012.

Exhibit A never appears in the docket and appears to have been floating around the Court house until it was returned to Chris Walters on September 12th, 2012. Given the irregularities in the actions of the Clerk�s Office and docket or Judge�s staff how much credence could the parties place in the official record; what was withheld from the Judge; and how accurate was the information place at the Judge�s disposal?

Under the circumstances the 2nd US Circuit Court of Appeals might give the new evidence due consideration and ask the same question Chris Walters did. Why would a federal judge who is the subject of a Judicial Conduct Complaint return key evidence to opposing counsel which would implicate the Court instead of accidently dropping the material into a paper shredder?

Exhibit C explains the Complaint was dismissed on August 5th, 2012 which is a Sunday. What Judge comes to work on Sunday their day off to dismiss an obscure Amicus Curiae?

A Motion for Summary Judgement and Finding-Questions of 3rd party tampering with Social Security Claims draws into question the constitutionality of Social Security Act. Unconfirmed information suggest the Motion was denied about April 24th, 2002.

Represenatives of UN High Commission on Human Rights agreed to consider receive information asking if HUD programs are in violations of International Covenant on Civil and Political Rights-Article 12 might be involved. Article 12 guarantees each person the right to choose where they reside. What is being asked is what right does the Government or churches have to compel a citizen to move from their county or place of residence? When a nonprofit agency indicates they do no accommodate persons with disabilities or ends a course of medical treatment being paid for by Medicaid the medical payment system is losing an estimated $50,000 per event.

Please find enclosed am Amicus Curiae brief addressing human rights concerns in programs operated by the United States under the 1503 Treaty Process. The questions were deferred to various committees of the US Congress to see if the United States can affect an internal solution to these issues.

Your Office seems to have jurisdictional authority over such matters and it seemed only natural to provide a copy for your staff and records.

Dear Under Secretary Maria Otero:

In the late 1990s the 5th US Circuit Court of Appeals(*) did not object to question on human rights violation occurring under color of US law to be removed to the UN High Commission On Human Rights and to the various committees of the US Congress. The complex questions of law are printed and also on the enclosed CD-Rom in a folder ssi/fgj/.

As your staff is probably aware in using the UN Human Rights Council 1503 Complaint prcedure we are considering the questions primarily as an amicus curiae to preserve the integrity of various US Statutes under a diplomatic process. The preparation of the data took quite a while and as you can see has been returned to the United States Congress for resolution as an internal matter.

The United States District Court ruled in Walters V Asture Civil: 09-0956 USDC, DC that private citizens may not file bries in federal court which propose to ask if a violation of Title 18 CRIMES has occured. More recently in Walters v Obrien, Ocampo Case # 3:11-cv-05906-RBL USDC, Western District Washington the Court dismissed the question with extreme prejudice as to wheather the UN Could even receive information on violations of international law and statute. As far as our staff can observe the Federal Courts are providing the best protection money can buy from US officials being prosecuted for violations of International Laws:

Beginning in 1997 a series of question concerning proposed amendments to the Social Security Act occurring in and around the US District Court in Western District of Texas were deferrer to the several committees of the US Congress under the provisions that amendments to US Statutes are eminent domain reserved under Article 1 Section 1 to Congress. The process generated an extensive operational audit of the Social Security Process and Medicaid program which give a lot data on operational impediments; frauds; and hoaxes operating these program.
Even though the reports are not completely edited they are sent up to government at least 1 time a year on the enclosed CD roms to as to give decision makers insight to government losses and possible solutions. Why for instance does it take 10 doctors 5 year to do a minor surgical procedure for cancer; 45 doctors 13 years to complete a colonoscopy; and other similar delays. The data is read as an html file on a standard computer and accessed by using the folder ssi/index.html

Because of the separation of powers the several US Circuit Courts of Appeals have reserved the legal matters to Congress as opposed to authorizing litigation in these areas.

This link concerns an attempt to cause the death of injury of the Plaintiff in this action directly in front of the Court which the Presiding Judge decided to ignore; didn't enter it into the Court records; and tried to conceal the fact by preventing an obvious appeal. The motive is probably that the Honorable Judge Preska is a Republican appointee who is simply toting the party line that while the United States is the prime enforcer of Human Rights world wide the United State is of course above the law and immune to prosecution.
