Changes In SSI Claim Without USDC ORDER/Review
Now Comes the Plaintiff Pro Se Chris Walters before the Honorable United States District Court to Petition the Court for Reconsideration of its Order of Dismissal to wit:

1. The Honorable Judge Judith Hererra, this Court, and the 10th US Circuit Court of Appeals acknowledge that a review of Chris Walters SSI claim or Final Denial of SSA Commissioner must be heard before a US District Court judge pursuant to Title 42 USC 405 (g)(H) Final Decisions of District Courts

2. In a related cause C08000483EMC USDC, NDC Magistrate Edward Chen stated the venue for such review does not reside in California and the letter docketed with this Court of April 17th, 2008 from Stockton Office of Adjudication and Review acknowledges the venue resides in New Mexico.

3. Exhibit A and B show copies of the Courts ruling have been served on Social Security Office of Hearings and Appeals in Falls Church Virginia and more recently the US Attorney in Sacramento, California.

4. In response to the Courts ORDER the Social Security Administration officials in California cut off Chris Walters state allotment of $233 a month and medical benefits and have compelled Chris Walters to travel 500 miles to Medford, Oregon to fill $500.00 in Medicade prescriptions monthly.

5. The actions of the officials have taken place without any apparent review by a US District Court and no written notice to Chris Walters and are obviously a direct snub directed at the bar of justice.

6. The Court is therefore asked to enter a Summary Judgement for $1.5 million dollars against the Social Security Administration for violation of Chris Walters rights to the due process and equal Protection of the law to a US District Court review guaranteed by Title 42 USC 405(g)(H) and the ORDERS of several Courts.
Oregonian Newspaper on August 2, 2008 free admitting that Congress has not given him adequate funds to maintain control of the Social Security Administration in an article describing the many persons who die during the SSI application process as a result of incompetence, abuse, frauds, and malfeaseance.
Discussion on Placing Social Security
Into Custody of a Special Master
The Court is not being asked to review the gruesome details of the newspaper article documenting the death of SSI applicants under questionable circumstances, nor the litigation surrounding payment of SSI back pay to dead persons but rather the simple public statement from the Commissioner of Social Security that his staff lacks the means to administer the Social Security Administration. A Special Master would control a toll free number on human rights and civil rights violations to deploy US Marshals on an emergency basis in complaints where obvious abuse is occurring and loss of life appears imminent . The Special Master will be empowered to disburse emergency funding to prevent death or serious injury where obvious administrative error is involved. If the Court finds this cause to have merit it is asked to move without waiting for Chris Walters to secure a new residence and mailing address or have the funds to travel to New Mexico to appear in person. I recently attempted to move into the River of Life Rescue Mission Medical Program however the time limit for my being able to stay is 17 days a month. A case manager had suggested I might be able to stay longer by joining the Accountability Program and doing volunteer work around the property. As you probably recall I have chronic communicable infections transmitted by casual hand contact and unofficial body count of more than 50 persons requiring medical treatment, Surgery, or hospitalization. This would preclude my working in a volunteer capacity as documents online:

As good fortune would have it I was able to fill my medical prescriptions at Walgreens Drug Store here in Medford, Oregon although the current medi-cal regulations in California wont fill them there.

Many thanks for the F&M Banks excellent services and your extension of over $500.00 in credit which the F & M Banks is legally entitled. I have been shorted in my SSI payments which the Regional Commissioner specified is $856.00 a month or about $256.00 (shortage) and understand the SSI has sent me a letter which I have not received on this subject.

As you can see from the enclosures the Judges who heard my SSI claim ruled recently that Social Security Administration cannot make any changes in my case status without review by a US District Court Judge. If the changes aren't the result of inadvertent error I will probably have to ask the several courts to sanction the Social Security Commissioner and his staff for Contempt of Court and decide on a suitable punishment for those involved.

Dear United States Attorney:

The Stockton Office of Hearings and Appeals had requested a review of the Social Security Commissioners Final Determination from April, 2007. The original Judge Judith Hererra of USDC, NM however ruled pursuant to Title 42 USC 405(g)(H) that such proceedings can only be adjudicated by a federal judge-not the agency itself. Rehearing the cause would normally be possible however in the case at bar the Social Security Administration immediately overturned the Commissioners denial and as it were kicked down the front door of the US District Court to claim I am disabled and award SSI with 4 years backpay The question of review was further complicated by the failure of the US to answer the Courts Summons and raising a question as to whether SSA was adequately represented by counsel.

The Stockton Office of Hearings and Appeals provided documents that the request was made by an Administrative Law William Herbert of San Antonio, Texas during a Secret Hearing on or about October 15th, 2007 while I resided in Lodi, CA. It appears that Judge Herbert is not licensed to practice federal law in either the 9th or 10 US Circuit Court of Appeals and has no standing to litigate in a case which has already been ruled upon by the Appeals Council.

7. Deprivation of rights under color of law Whoever, under color of any law, statute, ordinance, regulation, or custom, willfully subjects any person in any State, Territory, Commonwealth, Possession, or District to the deprivation of any rights, privileges, or immunities secured or protected by the Constitution or laws of the United States, or to different punishments, pains, or penalties, on account of such person being an alien, or by reason of his color, or race, than are prescribed for the punishment of citizens, shall be fined under this title or imprisoned not more than one year, or both; and if bodily injury results from the acts committed in violation of this section or if such acts include the use, attempted use, or threatened use of a dangerous weapon, explosives, or fire, shall be fined under this title or imprisoned not more than ten years, or both; and if death results from the acts committed in violation of this section or if such acts include kidnapping or an attempt to kidnap, aggravated sexual abuse, or an attempt to commit aggravated sexual abuse, or an attempt to kill, shall be fined under this title, or imprisoned for any term of years or for life, or both, or may be sentenced to death.

ALBUQUERQUE (KRQE) - A retiring FBI agent in the thick of investigating and prosecuting public officials said Tuesday New Mexico may be the most corrupt state in the nation. New Mexico has a long list of corrupt politicians, and the list could be growing. High-profile political figures and associates have been convicted, and ongoing investigations are making frequent headlines. Many of those cases began with FBI agents in Albuquerque.

"It's our No. 1 criminal program," Thomas McClenaghan, special agent in charge of the FBI Albuquerque field office, said. Corruption scandals that took down former state Sen. Manny Aragin, once considered the most powerful politician in the Senate. Former State Treasurer Robert Vigil, his predecessor and a long list of criminal accomplices have been convicted or cut plea deals in federal court.

McClenaghan will lead Albuquerque's team of FBI agents only through the end of the week. He retires on Friday. "From what we've seen here, corruption in this state is epidemic," he told KRQE News 13. "It is at all levels of government." New Mexico is not alone, of course. Illinois Gov. Rod Blagojevich is at the center of a federal investigation that had him arrested late last year. At the time Special Agent In Charge Rob Grant of the Chicago FBI field office had little good to say about how Illinois does political business. "If it isn't the most corrupt state in the United States, it is certainly one hell of a competitor," Grant said.

McClenaghan's take? "All I can say is Special Agent In Charge Rob Grant never worked in New Mexico." That's a strong statement from a man who's made it a point to pursue political corruption aggressively. When his agents went after Vigil, then the sitting state treasurer, undercover video showed a California financial consultant who was cooperating with the FBI handing him $10,000 in cash. At Vigil's first trial jurors couldn't decide whether he was guilty or not, and ultimately the evidence was not enough to convict him on 23 counts of racketeering, conspiracy and extortion. However Vigil was eventually convicted on one count of attempted extortion in 2006.
