I have recently contacted about 20 assisted living facilities within a 50 mile area; received 4 replies; and 1 no. I wanted to ask if an extended stay option beyond April 1 or pay to stay might exist for following reasons:

1. Preparation for hip and knee surgery.

2. Dr states I may first need to engage in weight loss program Involving change of diet and exercise for instance daily swims.

If such extension options exist I can produce on CD-rom extensive records for including medical history; finances. Ect� I believe my doctor can also produce a statement from my doctor if needed.

I recently moved to Santa Barbara County and am extremely impressed with the County indigent care and out reach services who helped me locate my very capable primary care physician Dr. Jane McClenanahan

Despite excellent services and outstanding programs I am embarassed to have to cancel my 2PM appointment today with Dr. McClenahan. As you can see from the enclosures the Casa Esperanza Shelters is having some problems controlling their clients. I am on a blood thinner Xeralto and as you can see from the fyi to the State can't afford to engage in fist fights with other clients.

I am officially going on vacation for a month (searching for another place to live for lack of other options) )and wanted to take thhis opportunity to thank you and Dr. McClenahan for excellent and exceptional services.

This is a question and recommendation for 90 day suspension of the 5013(3) Non Profit Status Of Casa Esperanza located at 816 Cacique Street, in Santa Barbara, CA 93103 base on apparent Inability to operate a safe service to the public within the requirements of the law. The Executive Director is believed to be Mike Foley, Manager is Imelda Lonza and another manager is Carmen Uribe.
Description of Services Offered This Agency
This organization provides services to homeless persons and specifically targets with programs persons with dependency issues; mental health concerns; physical health and disability issues; and winter guest. The Agency has a list or rules and regulations and guidelines posted for public inspection which include prohibitions concerning violence and threats directs at staff or guest.
Review of Particular Event About
2:45 PM Saturday, February 8th, 2014
The lab monitor Chris Walters is working on computer #1 and a guest who had a stroke last week is working on computer #2 and a veteran of war in Afghanistan is using computer #3. A young woman maybe in her early 20�s enters the room and begins using profanity and abusive language insisting the 3 men get up and leave. My general impression is the woman is trying to pick an actual fight with 3 men none of whom have ever spoken to this person or know anything about her.

After it was suggested this person take her complaint to the front desk she explained all she wanted was to use a computer and the men replied that computer #4 was open for anyone to use. After the woman began using the computer the disabled man on computer 2 said I am glad that is over and I replied someone is having a bad day.

At this point the young woman explained your talking behind my back I will have to teach you a lesson and began walking towards my computer. As she approached I was given to understand this woman who is maybe foot shorter than me and 200 pounds less in weight intended to start an actual fist fight.
Use of Accepted Protocol to Place Person Into Submission
I am retired from working in the security and investigations industry for about 40 years and have been trained to use a submission protocol on persons who are becoming aggressive and appear ready to fight. The protocol is generally effectively used on persons who are on drugs; Alcohol, mentally unbalanced and in some circumstances can be used on persons who are stupid. This protocol cannot be used on a person who is not impaired. As it generally the case it took between 2 and 3 minutes to bring the woman into submission. By the time the staff finally arrived the woman had changed from wanting to fist fight into explaining she was a victim of domestic violence who used to get beat up to 3 times a day by her husband. It would be really nice if someone could provide this person with serious counseling against approaching grown men and using profanity and aggressive behavior and trying to start fights.
Specific Area of Concerns
Relating To This And Other Issues
The management and staff permit the guest of this facility to watch quite a number of movies with extreme violence, aggressive and profane language which promote violence. I would have a hard time believing that a building full of persons who have mental health and other behavioral problems would benefit from watching a steady diet of this material without trying to act it out. The 5 known events between computer room monitors and guest on this particular day seem to facilitate around an active addictive need possibly not entirely different from additions to drugs and alcohols. A question is also appended asking if another guest is making improper sexual approaches to other men.
Statutory Citations
Threats against disabled persons or senior citizens is an enhanced felony in most states. When I work in the private security industry wear a uniform and carry a gun in Florida and Texas State for instance I have the legal right to summarily execute any person who I have a reasonable belief is attempting to cause

death or serious bodily injury to another person. Most statutes require the Board of Directors to be responsible for the operation of their non profit agency and the status of an organization to be a non profit is no a constitutional right but a matter of discretion that the operations of the facility are within the law. Since Chris Walters assumed residence here the State of California has a capitol investment of about $2,000 in SSA payments and several thousand of dollars in medical treatment. The requirement Chris Walters move as a result of this problem will create an unneeded burden on the taxpayers of California.
Recommended 90 Day Sanction
It would seem fair and equitable to give the staff and Board of Directors a fair chance to address the questions provided in this brief. If the organization is incapable of operating within the law and public interest it is suggested the non profit status of Casa Esperanza be suspended for 90 days to permit it to be reorganized.

A prelimminary brief is appended involving an incident at Casa Esperanza shelter on Saturday 2/9/2014 in which a young woman asked 2 disabled persons and a Afgrhan veteran to a fight. Although a police report was not taken since the woman indicated later to shelter staff she is a victim of domestic abuse possibly a professional victim the brief is enclosed for your staff consideration.

Further communications of a threatening nature between residents of Casa Esperanza and myself are already prohibited by existing ORDERS of several Courts.

Dear Chairperson Mariko Yamada:

The enclosed brief filed with the Santa Barbara County District Attorney Susan Dudley concerning an event involving guest of Casa Esperanza threatening several disabled persons on Saturday February 8th, 2014.

As you can see from the enclosures the Board of Directors and Management suspended from services a disabled person in an assisted mobility device for dissuading another guest who is apparently mentally unbalanced from committing a physical assault. It also appears further down in the document the shelters also permits sexual harassment.
Question of 90 Day Suspension
Of Casa Esperanza Non Profit Status

As of 2/14/2014 the communications from Chairman of Board of Directors and lack of response form Shelter management do not conform to existing criminal statute that harassment of an elderly person or Disabled person is an enhanced felony in most states. A suspension of this organizations nonprofit status might help the organization to reorganize and operate in a manner with laws and public interest.

The current Governor Garin Newsom appears to be a practicing career criminal whose leadership has turned California into a 3rd world country catering to those who seeek to be homeless by choice; free benefits for illegal migrants; early release for 18,000 convicted felons; extreme appliation of minority groups civil rights for instance LGBQ protection for children . The rape of the California unemployment benefits reportedly have resulted in theft of $20 Billion by criminal elements. The idea that the law is evil and the police should defunded leads to anarchy is ok is apparently a theme enpowered by some of the prosecutors state wide refusing to enforce laws. The migration of industry and wealth persons have created housing crisis in Missoula Montana as Montana is Californicated.

Many Doctors from India & Punjabi only have 2 years formal medical education before beginning practice in the United States and many need great deal of additional training. My 500 medical providers took 5 years for 10 doctors to remove melanoma; another 180 doctors to discover Xeralto to address blood clots; 150 doses of antibiotic to treat chronic infections; 50 doctors to decline my collapsed left hip cannot be replaced; and more recently a host of doctors; medical providers; and hospitals were unable to remove a reported renal cancer. A doctor in Texas stating he could take it out in 2 hours day surgery and send the patient home. Although the Advanced Medical Directive reviews what medical treatment is required many of my doctors routinely make changes in medications; order unneeded medical test; and make patient calls simply to defraud the Medicare or Medicaid Programs.

The US Supreme Court apparently empowered patient rights in Thersea Schiavo-Schindler, et al. v. Michael Schiavo, et al. protects the rights of patients to choose their medical treatment over the objection of medical or government officials as the operation of fact and law which lead to creation of a host of state and federal statutes to protect patient rights: (42CFR §483.10(c)) Patient Rights To Be fully informed by a physician of his or her total health status and to be afforded the opportunity to participate on an immediate and ongoing basis in the total plan of care. (42 CFR §483.10(c)(2),(4)) Be fully informed in advance about care and treatment and of any changes in care or treatment that may affect the resident.(42 C.F.R. §483.10(d)(3), 42 CFR §483.10(c)) Participate in planning care and treatment or changes in care or treatment unless adjudged incompetent or otherwise found to be incapacitated under State law. (42 CFR §483.10(c)(5)(6)To receive all information that is material to his or her decision concerning whether to accept or refuse any proposed treatment or procedure.
