After the US District Court had authorized filing the Complaint and service of process had begun the Social Security Administration (Docket #15 5-09-2007) and US Attorney (Docket #14 4/7/2007) made several request for an emergency or unauthorized 3rd party meeting at their Las Cruces, Office. The Social Security Commissioner then made a surprise admission of fact and law Rule 8(b) of Federal Rules of Civil Procedure that I had been approved for disability over a year ago and approved benefits the disability a matter of fact and law

The Court expressed no problems with the meeting and SSA Technical Expert Betsy Huber explained SSA was granting my SSI benefits with 4 years back pay and would rather pay than go to Court. The Court express no problem with the action at law being closed based on the informal agreement of the parties and stated the matter was "Well Pleaded"

On Informal Agreement of Parties
Now Comes The Plaintiff Pro Se Chris Walters before the Honorable United States District Court in the District of New Mexico to give Notice of Withdrawal of Lawsuit based on an informal agreement of the parties:

1. Over the last decade the parties have been in engage in the practice of law before several US District Courts, 1 or 2 US Circuit Courts; several Administrative Law Hearings; and before Committees of Congress and had their actual first face to face meeting on April 2, 2007 in With Technical Expert Betsy Huber the Social Security office in Las Cruces, NM which was very beneficial to all the parties involved.

2. Exhibit A: A letter the Social Security Administration dated March 26, 2007 that Chris Walters has been granted SSI benefits based on medical considerations going back to January 2004 which was appended by A Review Statement Summary Made for Supplemental Security Income made in good faith to Betsy Huber, Technical Expert at Social Security Administration on April 2, 2007 at Las Cruces, NM 88004.

4. Exhibit B: Letter from 5th US Circuit Court of Appeals: While there are unresolved issues and questions the parties will attempt arbitration in good faith as opposed to litigation as the FYI suggest.

5. Exhibit C: Letter from Dora M Fresquez New Mexico Support Division dated March 27, 2007 requesting medical evidence the Social Security Commissioner has already had expunged.
Discussion On Unresolved Questions/Issues
The Social Security Commissioner and his predecessors went to Court and demanded the extraordinary right to process a Social Security claim without medical records; testimony; or evidence and successfully challenged his own jurisdictional authority in Title 42 Section 7 Social Security Act. For the Social Security Commissioners or his agents or representatives to be in possession of Chris Walters medical or doctors records is an apparent violation of Title 18 USC 4 Contempt which as the 5th US Circuit Court of Appeals indicated is not open to debate or discussion.

Administrative Law Judge William Herbert made the correct decision to issue an ORDER OF DISMISSAL in July 2005 after lacking any legal right to possess medical evidence. The Appeals Council then ORDERED Judge William Herbert to Complete The Record” in December, 2005. While Judge Herbert’s “Notice Of Partially Favorable Decision cites a lot of evidence and a Social Security doctor it impeaches or strikes all of Chris Walters 160 or 170 some odd doctors including the Disability Finding of Washington State DSHS of 10-2005. Given the existing ORDERS of various Courts it is unclear why Judge Herbert’s “Notice of Partially Favorable Decision is itself entitled to present medical evidence or testimony.

Ms. Betsy Huber is a technical expert with 35 years experienced in working with the Social Security Administration and explained normally the Social Security Administration would contact the estimated 70 some odd doctors and clinics Chris Walters was treated by going back to 2004 and pay their bills. In the case at bar the Administrative Law Judge expunged all Chris Walters medical records and neither Chris Walters nor Ms. Betsy Huber have any clear idea how these medical authorities can be paid.

The request by Dora M Fresquez of March 27,2007 for all Chris Walters doctors within the last 6 months is best described as a violation of Title 18 USC 4 Misprison the felony. As the Plaintiff was given to understand the Social Security Commissioner will not require any additional medical testing for 3 years which is nice since the acquisition of Chris Walters medical records by the Social Security Commission is a prosecutable offense. So how do the parties proceed in good faith? As good fortune would have it the Social Security Commissioner is paid a large salary; has a large legal staff; and will avoid asking any more questions which have to be removed or supervised to the US Congress. Barring objection by the Court or the Defendant Chris Walters will consider the foregoing action at law withdrawn without prejudice.

1. The United States Supreme Court has enacted Constitional Law on the Right of Citizens to Interstate Travel comprised by 100 some odd rulings incuding such precedents as US V Guest (383 U.S. 745 (more) 86 S. Ct. 1170; 16 L. Ed. 2d 239) and Williams V Fears 179 U.S. 270 (1900)

2. The gest of the Supreme Court Law is that citizens have a well established right to engaged in interstate travel and live where they so wish. Generally it is beyound the power of the federal, state, or city governments to restrict these rights.

ALBUQUERQUE (KRQE) - A retiring FBI agent in the thick of investigating and prosecuting public officials said Tuesday New Mexico may be the most corrupt state in the nation.

New Mexico has a long list of corrupt politicians, and the list could be growing. High-profile political figures and associates have been convicted, and ongoing investigations are making frequent headlines. Many of those cases began with FBI agents in Albuquerque.

"It's our No. 1 criminal program," Thomas McClenaghan, special agent in charge of the FBI Albuquerque field office, said. Corruption scandals that took down former state Sen. Manny Arag�n, once considered the most powerful politician in the Senate. Former State Treasurer Robert Vigil, his predecessor and a long list of criminal accomplices have been convicted or cut plea deals in federal court.

McClenaghan will lead Albuquerque's team of FBI agents only through the end of the week. He retires on Friday. "From what we've seen here, corruption in this state is epidemic," he told KRQE News 13. "It is at all levels of government." New Mexico is not alone, of course.

Illinois Gov. Rod Blagojevich is at the center of a federal investigation that had him arrested late last year. At the time Special Agent In Charge Rob Grant of the Chicago FBI field office had little good to say about how Illinois does political business. "If it isn't the most corrupt state in the United States, it is certainly one hell of a competitor," Grant said.

McClenaghan's take? "All I can say is Special Agent In Charge Rob Grant never worked in New Mexico." That's a strong statement from a man who's made it a point to pursue political corruption aggressively. When his agents went after Vigil, then the sitting state treasurer, undercover video showed a California financial consultant who was cooperating with the FBI handing him $10,000 in cash. At Vigil's first trial jurors couldn't decide whether he was guilty or not, and ultimately the evidence was not enough to convict him on 23 counts of racketeering, conspiracy and extortion. However Vigil was eventually convicted on one count of attempted extortion in 2006.

That conviction was much needed motivation for the FBI discouraged by the outcome of the first trial. "We just felt that it may be hard to convict anyone in this state," McClenaghan said. They were much more successful in prosecuting the coconspirators who skimmed $4 million from the $80 million spent to construct the Bernalillo County Metropolitan Courthouse in Albuquerque.

By late last year a total of eight people pleaded guilty in the scheme including Arag�n who admitted he accepted illegal kickbacks. "We were eventually were able to convict everybody without even going to trial," McClenaghan said. And, he added, the work at the FBI field office is far from over. McClenaghan would not comment on any current investigations including the probe of the Richardson administration's dealings with a California investment company that did business with the state about the time it contributed money to Richardson political committees.

Please find attached a question addressed to the United States Attorney Larry background="../images/ on a Federal Grand Jury investigation of the Las Cruces Gospel Rescue Mission in question of law including alleged violations of Title 18 USC 1512 Retaliating against a witness, victim, or informant; assisting a violation of Title 18 USC 371 Conspiracy to commit offense or to defraud the United States (Social Security; possibly allowing state parolees to practice in Satanism or demonic activities while engaged in a Christian Rehabilitation Program.

Another 3rd party alleges that the Rescue Mission staff actively requires sexual favors from persons or employees within the organization seeking promotion or advancement.

Another client a Thomas Reed openly professes to be a major drug dealer who has never been captured or arrested and identified a $2 million vessel in the Key West harbor he owns which he explains were purchased with drug monies. It is not clear whether Mr. Reed is currently engaged as a drug smuggler or simply trying to recover from his previous lifestyle and turning over a new leaf.

Thomas is not shy about sharing his stock and trade as an international drug dealer with an passer by in quite intricate detail which might make a person wonder if he is legitimate?

The House Judiciary Committee released a 700 page report on efforts by White House Advisor Karl Rove and Harriet Miers to fire New Mexico US Attorney David Iglesia in order to tamper with the bar of justice in the State of New Mexico. report can be viewed on line at this link

2005 White House "Decision" to fire David Iglesias – It has previously been known that New Mexico Republicans pressed for Iglesias to be removed because they did not like his decisions on vote fraud cases. New White House documents show that Rove and his office were involved in this effort no later than May 2005 (months earlier than previously known) - for example, in May and June 2005, Rove aide Scott Jennings sent e-mails to Tim Griffin (also in Rove’s office) asking "what else I can do to move this process forward" and stressing that "I would really like to move forward with getting rid of NM US ATTY." In June 2005, Harriet Miers e-mailed that a "decision" had been made to replace Iglesias. At this time, DOJ gave Iglesias top rankings, so this decision was clearly not just the result of the White House following the Department’s lead as Rove and Miers have maintained.1

Iglesias criticized by Rove aide for not "doing his job on" Democratic Congressional Candidate Patricia Madrid – An October 2006 e-mail chain begun by Representative Heather Wilson criticized David Iglesias for not bringing politically useful public corruption prosecutions in the run up to the 2006 elections. Scott Jennings forwarded Wilson’s email to Karl Rove and complained that Iglesias had been "shy about doing his job on Madrid," Wilson’s opponent in the 2006 Congressional race. Just weeks after this e-mail, Iglesias’ name was placed on the final firing list.2

An "agitated" Rove pressed Harriet Miers to do something about Iglesias just weeks before Iglesias was placed on the removal list "Karl Rove phoned Harriet Miers during a visit to New Mexico in September 2006" according to Miers testimony, Rove was "agitated" and told her that Iglesias was "a serious problem and he wanted something done about it."
Senator Domenici personally asked Bush's Chief of Staff Josh Bolten to have Iglesias replaced In October 2006, Senator Domenici stepped up his campaign to have Iglesias replaced. According to White House phone logs and emails, as well as Rove’s own testimony, Domenici spoke with President Bushs Chief of Staff Josh Bolten about Iglesias on October 5, 2006, and during October 2006, Domenici or his staff spoke with Karl Rove at least four times.

Todd Graves removed in Roves "approved deal with Republican Senator Kansas City U.S. Attorney Todd Graves was removed as part of a White House brokered deal with U.S. Senator Kit Bond. In exchange for the administration firing Graves, Senator Bond agreed to lift his hold on an Arkansas judge nominated to the Eighth Circuit federal appeals court. A White House e-mail stated that "Karl is fine" with the proposal.

Miers obtained favorable statement on Rick Renzi in violation of DOJ policy When rumors of the FBI investigation of Rep. Rick Renzi surfaced in October, 2006, one of Roves subordinates contacted Harriet Miers, who called Deputy Attorney General McNulty seeking a possible statement that would have "vindicated" Renzi. Even though this was contrary to standard DOJ policy, such a statement was issued several days later.

7. ALBUQUERQUE (KRQE) - A retiring FBI agent in the thick of investigating and prosecuting public officials said Tuesday New Mexico may be the most corrupt state in the nation. New Mexico has a long list of corrupt politicians, and the list could be growing. High-profile political figures and associates have been convicted, and ongoing investigations are making frequent headlines. Many of those cases began with FBI agents in Albuquerque.

"It's our No. 1 criminal program," Thomas McClenaghan, special agent in charge of the FBI Albuquerque field office, said. Corruption scandals that took down former state Sen. Manny Aragin, once considered the most powerful politician in the Senate. Former State Treasurer Robert Vigil, his predecessor and a long list of criminal accomplices have been convicted or cut plea deals in federal court.

McClenaghan will lead Albuquerque's team of FBI agents only through the end of the week. He retires on Friday. "From what we've seen here, corruption in this state is epidemic," he told KRQE News 13. "It is at all levels of government." New Mexico is not alone, of course. Illinois Gov. Rod Blagojevich is at the center of a federal investigation that had him arrested late last year. At the time Special Agent In Charge Rob Grant of the Chicago FBI field office had little good to say about how Illinois does political business. "If it isn't the most corrupt state in the United States, it is certainly one hell of a competitor," Grant said.

McClenaghan's take? "All I can say is Special Agent In Charge Rob Grant never worked in New Mexico." That's a strong statement from a man who's made it a point to pursue political corruption aggressively. When his agents went after Vigil, then the sitting state treasurer, undercover video showed a California financial consultant who was cooperating with the FBI handing him $10,000 in cash. At Vigil's first trial jurors couldn't decide whether he was guilty or not, and ultimately the evidence was not enough to convict him on 23 counts of racketeering, conspiracy and extortion. However Vigil was eventually convicted on one count of attempted extortion in 2006.
