The Honorable Chief Judge Bruce Black in hearing a civil action expressed on problems with a Bank opening and seizing a Safe Deposit Box of Counsels legal papers without any Court ORDER or other legal authorization. The Court's ruling is a serious challenge to every citizens right to privacy not to mention the sancity of counsels papers. This is a technical brief prepared for the Social Security Commissioner and his staff on unforeseen technical difficulties which have prevented completion of the proposal to find permanent housing and address medical issues. We filed a courtesy Notice that I am on Extended Leave of Absence and have received word that:

1. Medical authorities in Boise, Idaho explained that the Lovelace Health Plan would not authorize payment for medical work LH1226640*00 which occurred out of state and it appears that the Boise Rescue Mission which provided housing is a refuge to convicted child molesters and sexual predators.
2. The UPS Corporation which handles my mail by contract has sent me a nice email thanking me for the postcards however could not email me for 2 months to explain why they would not forward my mail.

3. The nonprofit agency in Bristol, Tennessee explained the office for persons wishing to apply for Medicaid is so far away that there is no bus service for persons seeking to apply for services.

4. After arriving in San Antonio, Texa I was seen at Metropolitan General Hospital and given a prescription for cardiac and circulation related issues and learned that Lovelace Health Plan has canceled my medical insurance several days ago.
Do We Have a Realistic
Chance of Success At this Point?
I am currently spending upwards of $300.00 a month on Greyhound bus tickets; eating on the road; motels; and don’t currently appear to have a realistic chance at this time of getting a permanent place of residence and medical work addressed due to what appear to be technical difficulties. While I am trying to get a workable solution in place and can’t make any solid promises progress I would suggest the Social Security Administration simply keep me a resident of New Mexico since we have the capabilities to receive mail (in theory) until something else works out.

Really Neat Bank Fraud By Bank of America
This is a really neat bank fraud by Bank of America where it takes debits and fails to pay them and puts them into a 10 day to 14 day float as was done 30 years ago when everything was paper. The fraud generates a incorrect balance to the customer who then over drafts and gets whacked $35.00 for each item the bank is sitting on.

Progress Report On Finding

Permanent Low Income Housing

As your staff might recall I was asked to check several communities for permanent low income housing and did in fact check resources in Las Cruces, New Mexico: Boise, Idaho; Bristol, Tennessee; and even San Antonio, Texas. Most of these communities either have a cost of living higher than I can afford; or a year long wait for public housing or as in the case of San Antonio Texas actually lack canceled my medical insurance in New Mexico without providing some means for me to get my prescriptions filled. While I am sure I will eventually find affordable low income housing I have spent a small fortune on Greyhound Bus tickets; motels; and other expenses and don't believe further effort should be invested at this time. So I plan to simply take up residence in the homeless shelters here in this area; apply for Medic-Cal; and wait patiently on better opportunities. Chris There is section 8 housing in Napa County however I understand that the wait list is very long and it takes 3 to 5 years once you are on the list to actually get a voucher. I suggest that you contact the Housing Authority for the City of Napa for more details. They are the managers for that program county-wide. You will find information for the Housing Authority at www.cityofnapa.org. We do have a year-round homeless shelter. Access to the center is done through our HOPE Resource Center located at 1301 4th Street in the city of Napa. It is open Monday through Friday from 8 a.m. to 5 p.m. Pre-screening is done there for the shelter and referrals are made to the shelter as appropriate. We do not allow any walk-in without referral to the shelter. You must be present at the HOPE Center to do the screening. Stay at the shelter is evaluated week-by-week with a 4 week limit per year for level one (basic emergency shelter). It is a clean and sober facility and all persons are drug tested on entry and randomly throughout the week. Everyone is breathalized for alcohol each time they enter the building.

Chris that amount of time you need is not realistic for us as we try to move people forward in 90 days or less. Also, since the bulk of our funding comes from Napa County and the City of Napa, we do, at their request, give people who are from Napa County the first shot at any available beds. The cost of living in Napa – especially available apartments and rooms is also quite high. Most of our folks with SSI find it very difficult to rent a place without some sort of assistance or a roommate. I would think that the Stockton area would be more affordable but I am not an expert. I do know that as a bay area county we tend to have some of the highest rents in the US. Are you by chance a veteran with an honorable discharge or are you over 55? If so, there may be other options.

$35.00 Bank of America created another questionable overdraft payment where reciepts and bank statements show $35.00 charge unjusitified. The bank reciepts and printed statements clearly show items being reposted or reordered to create overcharges. Now Comes the Plaintiff Pro Se Chris Walters (SSI 261-90-6357) before the Honorable US District Court to enter this Notice That The Social Security Administration experts are explaining that low income housing may not be a current achieveable goal to wit:

1. Exhibit A the Social Security Administration has waived service or process in April, 2007 in USDC (Docket #1-15) and agreed with the Court (Docket #11) that SSI benefits with 4 years backpay ($19,000) would be granted and the Plaintiff Chris Walters is on extended leave to find affordable housing (Docket #18).

2. While Chris Walters currently claims to reside in Lodi, California San Joaquin County has closed it's low income housing program in August, 2006 and as Exhibit B an email from Napa County further explains low income housing options are closed in that county also.

3. While checking options in San Luis Obispo on September 11th, 2007 Chris Walters spoke to the Social Security Administration's staff who confirmed information from social service agencies that the waiting list for low income housing has at least a 1 year waiting period.

4. on or about 9/1/2007 Dr. James Grady of the Lodi Urgent Care Clinic explained that the last doctor in Lodi to accept Medi-Cal a Dr. Steele has retired and Physician Assistant E Hixon of San Luis Obisop County Health is acting as Primary Care Physician to provide Chris Walters medical treatment.

Meritorious Offer Of Extra Ordinary Assistance
While the parties before the US District Court have agreed to a reasonable course of action to including permanent housing for Plaintiff Chris Walters and medical treatment many of the communities queried in the last 5 month explain they lack the resources to achieve the stated goal. The Social Security Commissioners San Luis Obispo staff did explain a possible workable option along these lines:

1. $1869.00 in back pay is schedules arrive in November, 2007 and could be used to cover first and last month rent; security deposit; and other essential if affordable housing can be located

2. Recent information suggest that Las Cruces New Mexico has Section 8 Housing at this time and Chris Walters might ask if Technical Expert Betsy Huber (505-523-9313 (ext 1215) would be able to work with Chris Walters or a 3rd party to arrange a place of housing downtow?

3. The Social Security Commissioner is apparently holding something $19,000 in backpay which might be used to move the interest of the parties forward.

An informal agreement was reached in Walters v. Astrue USDC, NM 07-CV-257 in April 2007 which was approved by the Honorable Judge Hererra which provided that Social Security agreed to pay SSI going back 3 years of $19,000 in backpay and pay outstanding medical bills going back to 2004; no new medical evaluations will be required prior to April, 2010; and Chris Walters will attempt to find low income housing and get a primary care physician to fix what is broke. Your staff however subsequently:

1. Exhibit A: Letter dated June 5th, 2007 states Social Security declines to pay back medical bills going back to 2004. Although I have secured a ruling in Texas State District Court against Experian Credit the outstanding medicals damage my credit rating and severly limit my ability to rent housing

2. Exhibit B: Letter dated August 14th, 2007 states Social Security is considering withdrawing my SSI benefits because I am not in New Mexico-after I have filed on the US District Docket #18 in May, 2007 that I am on extended leave of absence to look for low income housing (Quite a number of communities have states their Section 8 Housing List is closed or has years long delay.

3. Exhibit C: we have a 3rd party who has seized a registered mail which contained my eyeglass prescription paid for by Medicade and intercepted the US District Court Order Docket #20 apparent violations of Title 18 CRIMES.

4. I made a written request to your Lodi Office to find out how much of the $19,000 in back pay still exist which was not answered. Given the successful conclusion of the previous issues filed in a US District Court I might ask why the Social Security Administration would want to go back to a US District Court in District of Columbia where the Chairman of the House Ways and Means Committee and Chairman of US Senate Committee Select Committee on Aging have to be brought in and rehash old business and ask for substantial puntative damages? Wouldn't it be easier to keep the existing agreements?

During a phone call with Medi-Cal I learned they are still using General Delivery-Lodi, CA. After calling the 1-800-772-1213 number they explained the new mailing address would be noted. I later got Social Security to list my correct address on correspondence.

Deprivation of rights under color of law Whoever, under color of any law, statute, ordinance, regulation, or custom, willfully subjects any person in any State, Territory, Commonwealth, Possession, or District to the deprivation of any rights, privileges, or immunities secured or protected by the Constitution or laws of the United States, or to different punishments, pains, or penalties, on account of such person being an alien, or by reason of his color, or race, than are prescribed for the punishment of citizens, shall be fined under this title or imprisoned not more than one year, or both; and if bodily injury results from the acts committed in violation of this section or if such acts include the use, attempted use, or threatened use of a dangerous weapon, explosives, or fire, shall be fined under this title or imprisoned not more than ten years, or both; and if death results from the acts committed in violation of this section or if such acts include kidnapping or an attempt to kidnap, aggravated sexual abuse, or an attempt to commit aggravated sexual abuse, or an attempt to kill, shall be fined under this title, or imprisoned for any term of years or for life, or both, or may be sentenced to death.

New Mexico "The Most Corrupt State In the United States"

ALBUQUERQUE (KRQE) - A retiring FBI agent in the thick of investigating and prosecuting public officials said Tuesday New Mexico may be the most corrupt state in the nation. New Mexico has a long list of corrupt politicians, and the list could be growing. High-profile political figures and associates have been convicted, and ongoing investigations are making frequent headlines. Many of those cases began with FBI agents in Albuquerque.

"It's our No. 1 criminal program," Thomas McClenaghan, special agent in charge of the FBI Albuquerque field office, said. Corruption scandals that took down former state Sen. Manny Aragin, once considered the most powerful politician in the Senate. Former State Treasurer Robert Vigil, his predecessor and a long list of criminal accomplices have been convicted or cut plea deals in federal court.

McClenaghan will lead Albuquerque's team of FBI agents only through the end of the week. He retires on Friday. "From what we've seen here, corruption in this state is epidemic," he told KRQE News 13. "It is at all levels of government." New Mexico is not alone, of course. Illinois Gov. Rod Blagojevich is at the center of a federal investigation that had him arrested late last year. At the time Special Agent In Charge Rob Grant of the Chicago FBI field office had little good to say about how Illinois does political business. "If it isn't the most corrupt state in the United States, it is certainly one hell of a competitor," Grant said.

McClenaghan's take? "All I can say is Special Agent In Charge Rob Grant never worked in New Mexico." That's a strong statement from a man who's made it a point to pursue political corruption aggressively. When his agents went after Vigil, then the sitting state treasurer, undercover video showed a California financial consultant who was cooperating with the FBI handing him $10,000 in cash. At Vigil's first trial jurors couldn't decide whether he was guilty or not, and ultimately the evidence was not enough to convict him on 23 counts of racketeering, conspiracy and extortion. However Vigil was eventually convicted on one count of attempted extortion in 2006.
