Under the law, the applicant is responsible for furnishing evidence to support the claim. Although you have been requested to furnish additional evidence, you have not done so. We based our determination on this evidence because you did not take the medical examination we asked you to have at our expense. The examination was needed to fully evaluate your condition. Therefor a determination has been made based on the evidence in file. The evidences does not show that you are disabled

You said you are unable to work because of involuntary bowel movements, can't bend, life or stoop, skin cancer, and can't work outside and infections

The evidence shows that you do have a history of loose bowels with urgency. While loss of bladder or bowel control is quite botherersome, this condition can usually be treated and special garments are available to wear. You were seen at the emergency room for pain in your left lower leg. You had good pulses and good skin color. There was no sign of infection and there was no swelling. X-rays of your left foot and ankle did not show any acute process. A venous duplex study did not show any deep vein thrombosis. While you have stated that you havd had skin cancer, there was no evidence of any skin cancer or any reoccurence at your last emergency room visit on 3-6-02. On 1-2-02 you were seen at the emergency room and treated for impetigo, an infection of the skin. This condition usually responde to treatment. You had no swelling or tenderness in your extremities. There is no evidence of treatment for a disabling condition that owuld provent you from bending, lifting or stooping. You are able to move about, walk, and stand, and to use your hands and arms in a satisfactory manner.


After reviewing your claim, we found that more medical evidence was need and the rescheduled examinations. We explained to you that it was your responsibility to report the these examinations. We explained that if failed to keep these appointments, a decision on your disability claim would be made on the information in file and this could result in a finding that you were not disabled.

We told you that if you did not keep the appointment, a decision would be made based on the information in your file. The evidence needed to decide your claim is not available to us. Therefore your claim for benefits must be denied.

Problems In Legs
3-2002 Dr. Wenger Emergency Room Physician of Rockingham Memorial Hospital had seen Chris Walters about inability to walk due to serious pain in lower left leg. Some suggestion of blood clots was made and no evidence of gout was found in blood test. Medication was "Ecutron" an asprin has apparently resolved the problem.

Excuse me doctor could you tell me about the new 3 year asprin. Yes of course. It took 3 years and many doctors to finally do a sonar exam of Chris's leg and determine he had blood clots, which an asprin a day would cure.

7. Deprivation of rights under color of law Whoever, under color of any law, statute, ordinance, regulation, or custom, willfully subjects any person in any State, Territory, Commonwealth, Possession, or District to the deprivation of any rights, privileges, or immunities secured or protected by the Constitution or laws of the United States, or to different punishments, pains, or penalties, on account of such person being an alien, or by reason of his color, or race, than are prescribed for the punishment of citizens, shall be fined under this title or imprisoned not more than one year, or both; and if bodily injury results from the acts committed in violation of this section or if such acts include the use, attempted use, or threatened use of a dangerous weapon, explosives, or fire, shall be fined under this title or imprisoned not more than ten years, or both; and if death results from the acts committed in violation of this section or if such acts include kidnapping or an attempt to kidnap, aggravated sexual abuse, or an attempt to commit aggravated sexual abuse, or an attempt to kill, shall be fined under this title, or imprisoned for any term of years or for life, or both, or may be sentenced to death.
