of Sedition & Insurrection Deferred To US Circuit Courts of Appeals
per Title 28 USC 328 aka Judicial Disability
Since the civil war the United States has maintained the statutory authority and exercised the legal right to summarily execute public and private persons engaged in sedition, insurrection, or treason against the United States. It seems plausible that possible future challenges to the Rule of Law and ORDERS of the numerous Courts closing the conversation by unrecognized 3rd parties might be considered challenges to the ability or disability of the various Judges.

Title 28 USCS 372. Retirement for disability; substitute judge on failure to retire; judicial discipline appears ideally suited to remove such challenges reviewed by the Circuit Executive of the US Circuit Court of Appeals. Public or private 3rd parties who are not recognized as parties of interest can if they so wish appear and give the finger to the bar of justice in person and question the fitness of various Judges to issue rulings; ORDERS; and exercise their judicial duties.

The US Circuit Court of Appeals in considering the matter can decide if the various 3rd parties are engaged in sedition, insurrection, and if they should be summarily executed; knee capped; pistol whipped by a US Marshal or otherwise sanctioned.

� The city of Boise could see its tab for losing a lawsuit over housing for the homeless climb from $1 million to nearly $3 million once attorneys' fees and costs are added.

A federal jury ordered the city to pay $1 million to Community House in September, after finding that the city discriminated against homeless women and children and retaliated against the organization when board members complained. Now the attorneys that represented Community House in the lawsuit are asking that their client be compensated for fees and costs � which they say total nearly $1.9 million.

Under federal law, the winner of a lawsuit can generally seek to recover attorney's fees and costs from the losing side. The fees and costs have to be approved by a judge and they can be appealed, just like the verdict itself. But they can substantially raise the financial stakes for the losing party. Attorneys for the city, meanwhile, have asked U.S. District Judge Candy Dale to issue a judgment notwithstanding the verdict � a legal move in which a judge can set aside a jury's finding and issue a new verdict � or to hold a new trial.

In the city's motion filed Wednesday, the city contends that the judge made mistakes during the trial and that the verdict wasn't supported by the evidence presented in the case. In Community House's motion for attorney's fees and other supporting documents, also filed Wednesday, attorney Howard Belodoff said that he and several other attorneys and staffers with Idaho Legal Aid Services worked on the case over the past seven years. "Given the complexity and difficulty of the issues, the appeals, the defenses raised by Defendants, the length of time it took before a jury heard the case and contingent nature of the case, few if any attorneys would have considered representing the plaintiffs who had no resources to compensate counsel or pay the costs,"

Belodoff wrote in a court document. Community House and the city of Boise worked together in the 1990s to build and run a homeless shelter and soup kitchen, funded largely through federal grants and private donations. But over time, the relationship began to unravel, and in 2003 the city began looking for a new organization to run the shelter. When Community House officials learned the city planned to partner with the Boise Rescue Mission � which houses only men � Community House filed a complaint under the Fair Housing Act contending that the move amounted to discrimination against the homeless women and children currently living there because it would leave them with no place to go. The city of Boise officially entered into a lease-and-purchase agreement with the Boise Rescue Mission in 2005, passing an ordinance to make it a shelter for men only.

Community House then sued in federal court, bringing a number of claims including discrimination and retaliation. The city strongly denied those claims and the lawsuit eventually went to trial in August. After 11 days of testimony and arguments, the federal jury sided with Community House, finding the city violated the state constitution, discriminated against homeless women and children and retaliated against Community House. The jury awarded the organization $1 million, which Belodoff said would be used to house and provide for homeless families, women and children. After the verdict was announced, Boise city spokesman Adam Park released a prepared statement in which the city again denied any discrimination and said the $1 million award was without basis. The statement went on to note that even if the city were to fail in its efforts to overturn and reduce the damages, that amount would likely be covered by the city's insurance policy and not come out of taxpayer funds.

As you can see from the attached medical history we have had 10 doctors take 5 years to do simple in office surgery for cancer which was completed by Dr. Donald Steph in 1997; 100 doctors prescribe 100 doses of medication until Dr. Thomas prescribed Vancomycin; 45 doctors took 13 years until Dr. Schmidt did a colonoscopy; diabetes went away when a doctor took me off Lovenox. I recently returned from North Carolina whose state budget dispenses Lovenox and Heparin products like water and was hospitalized 8 times in 6 months at an estimated costs of over $100,000.
Case Plan and Purpose of Our Activities
While many medical authorities have attempted to treat these conditions only a few have healed or repaired an existing medical problem. Outstanding problems I am attempting to resolve include:

1. $5.00 reward for name or organ which regulates how much water there is the body and finds a way to get rid of the 120 pounds of extra water I now carry.

2. Consultation with Orthopedic surgeon who will hopefully figure out what to do about partially displocated his which impairs movement and contrary to staff medical notes is very painful.

3. Gallbladder surgery which a hospital recommended.

4. Control of chronic MRSA and staff infections by remaining clean; in clean clothes; and in a clean environment.

As regards the proposal of medical staff to move me to an assisted living facility on September 1, 2011 and I have asked a 3rd party to act as arbitrator to postpone the move until 10-1-2011 based on:

1. The Orthopedic Team at St. Als will see me August 25th, 2011 to see if I need surgery or some other treatment for chronic hip problems which would simply return me to your facility.

2. In moving I will miss my September SSI and Medicaid payment and possibly have to be suspended again-causing additional litigation.

3. The US Attorney has just filed with USDC that they believe the suspension of my benefits was not legal and may wish to consider a criminal complaint per 28 USC 1915 (e)(2)(b)
Case Screening
1. If anything were to go astray in the proposed move and I was say forced to leave Idaho the Court and USA would seek to assign blame and sanctions on someone.

2. As you can see from the attached Brief I have asked the US District Court to issues a temporary injunction to prevent my moving out of your facility prior 10-1-2011.

3. If the US Attorney and US Magistrate concur they will Quash any objections by Medicaid.

I Plaintiff Chris Walters and am going to withdraw the Complaint in Walters v Asute 11-cv-00359LWB and wanted to thank and commend your staff for providing the relief I had sought in USDC through prompt effort and saved valuable Court and Attorney time.

I have attached a working draft copy of the Motion To Withdraw as an image file and hope to have the signed origionals in the mail by no later than Monday. You can see I have asked the Court to consider any relief or request for judicial review your client might seek if you so desire along with any recommendation for a hearing before US Magistrate.

I do apologize for not being able to send paper documents for the proposed several emergency motions as I was not able to leave the skilled nursing facility for 8 days because of a hip problem without medical supervision. Lacking access to soft ware to create a PD I could not electronic filing; and although I am registered for PACER cannot access many court documents. I hope to have the signed origional in the mail to your office and to the Court no later than this Monday.

10. Life Threatening Medical Mistake Dr. Hinchman finds Coumadin level at fatal level INR 9 because of Kindred failure to do blood test.; and problem continues.

11. SSA suspends SSI and Medicaid without proper judicial review: Walters v Asture USDC ID 11-cv-00359

12. Phone messages not being forwarded by Kindred noted by Sunnyside.

13. $10 Medicaid payment for August and September,2011 do not appear; possibly pilfered by staff of Kindred Transitional Rehabilitation.

14. $30 SSA August, payment from Kindred delayed payment until September 8th , 2011

15. Docket #22 Walmart VISA Card Missing in US Mail reported stolen. Walmart charges $6.00 replacement fees.

16. Terrorist Threats: Reports Mr. Kunzler is phone calling threats into Kindred causing concern from facility staff.

17. Docket #20: Kindred requires me to move out of their facility without adequate notice or legal review by Presiding Judge.

18. Because of partially dislocated hip I am a substantial fall risk and the assisted living facility is not equipped to deal with this medical problem.

19. Diabetic Shoes delivered are 2 sizes too small.

20 Heritage Staff being $2,000 a month and is unable to fix television remote.

21 Heritage Assisted Living has many spiders and bed bugs needs exterminator.

22. CPAP Machine has loose hose connection which technician cannot fix.

23. Dr. Timothy Ruth declines to resume as PCP and Heritage staff suggest I should not be seen anyone at St. Luke Hospital in future.

24 Heritage Assisted Living is unable to arrangements for blood test for Coumadin INR and the medical staff is apparently unable to deal with this medical problem.

25. SSI check for month of September, 2011 is $30.00 short and it appears possible Kindred Transitional has money however has not forwarded it to me.

During the past 2 months of residence here at Kindred I have accomplished more than at any other time in memorable past in terms of moving forward with medical work; updating and completing record keeping and feel this is largely due to your excellent staff and home type atmosphere.

If we extend in residence through September, 2011 I would propose to:

1. Get appointment with vascular surgeon to see if long term option exist for treatment of chronic DVT possibly including surgical options or medication such as Pradaxa.

2. Get medical referral on gall bladder surgery to remove gall stones.

3. Consult with in house staff on moving forward with hip surgery option to see if what hip surgeon wanted is achievable.

4. Follow up appointment with Sleep Center 9-8-2011; receive diabetic shoes;

5. Complete loose ends related to SSI case in USDC Court; if a move is being made in October, 2011 I will have VISA Card for direct deposit ready by 9-15-2011; notify SSA in a timely manner to avoid losing benefits.

6. If we anticipate a move from your facility in the near future for non medical reasons I have made inquiries with your Salem Oregon Affiliate Sunnyside Care Center 503.370.8284 whose case worker has emailed they will speak to your staff.

7. The person making terrorist threats has not been heard from in about 10 days and is presumed to be no longer a problem or threat.

Dear Diane Harrington:

I wanted to thank your excellent staff and commend your organization on its excellent services in the last 12 days I have resided in your facility. An unforeseen medical problem has occurred which will require me to move to another state for medical reasons. As your staff probably recalls I was recently moved from Kindred Transitional Care to your facility in a very short period of time and did not have time to secure the services of a Primary Care Physician and Dr. Timothy Ruth has declined to continue as PCP.

As your medical staff is aware I am being treated for chronic deep vein thrombosis and taking a highly toxic medication known as Coumadin which has to be maintained at a 2-3 on the INR scale to avoid becoming lethal. A few weeks ago the INR was 9 and then found to be a 5 and the blood level has not been tested in several weeks.

Your excellent medical staff wanted to have the blood work checked last Friday however I will not be able to get a doctor to authorize the test until the 26th, of this month. As I explained to your Nurse Lisa I would normally get around this problem by simply going to the ER to have the test done. Unfortunately as Lisa explained due to some technicality I am not permitted to have the blood work done at the ER.

Given the nature of the problem I am taking an emergency medical leave from your facility with the intent to move to another State officially as of October 1, 2011. I believe this will enable your facility to get paid by Medicaid for this month.
