Missoula Montana is a rather beautiful place with nice scenery and friendly people and a small town atmosphere. I am off Greyhound with a swollen leg and find a treatment option through Poverello House and Partnership Health Center.

I am requesting an updated SSI Awards letter so as to file for Medicaid here in Montana and expect doctors to place me back in either Skilled Nursing Facility or Assisted Living facility when needed documentation arrives.

As you can see from the enclosed document filed in a Courtesy brief in USDC, MDNC I have completed an emergency move for medical reasons after NC refused to issue Medicaid Card. The documentation shows I was successfully hospitalized and treated for blood clots at Pinnacle Hospital in Harrisburg, PA.

While the Commissioner has explained he will request a hearing pursuant to Title 42 USC 405(g)(H) Judicial Review in several years the several US Circuit Courts of Appeals who previously review the questions authorized non statutory events such as the refusal to issues Medicaid removed to several Congressional Committees so as to avoid burdening your staff with these matters. Documentation is attached showing this process.

The nice young woman on the phone in Maryland indicated she was unable to forward my address because someone in afield office has the case open. She states she will try and update my address and mail an awards letter later today. The SSA local representative Tasha apparently turned on my SSI; Medicaid; requested a return call on 8-14-2012. I left several messages but Tasha has not checked her voice mail; been seen; or heard from???????

August 14, 2012 at 1:30 PM Raphael in San Diego was able to move the SSI claim to Missoula Montana and get an Awards Letter rolling so I can sign up for Medicaid. Raphael indicated Tyler, Texas had open SSI case from when I tried to reside back several months ago

A real tiger on his medical protocols PA Win is doing a more through job than most of doctors. Has me on Fragmin and Coumadin with follow up with INR check.

First check for INB on Ausugt 17th, 2012 was as expected still at 1.0. No change in theraputic level. Authorized to double Coumadin intake to 10mg a day

The authorized protocol involves hospitalization for 3 or 4 days to administer Heparin through IV. PA Winslow authorized medication Nexium which the pharmacy substituted for Prilosec which is less effective treatment.

Partnership blood test for basic values show no major problems.

Excellent service with a smile as Dr. Daniel Gee preforms minor surgery on apparent bed bug bite of some sort on left knee.

In a 4 day period 50 bed bugs were caught or kills on my bed at the Poverello. We are dosing the bed with heavy treatments of Isoproply Alcohol. They have been found with methicillin-resistant Staphylococcus aureus MRSA[35] and with vancomycin-resistant Enterococcus faecium (VRE), but the significance of this is still unknown.[36]

This referral was contracted 8-23-2012 and the information maybe useful in getting placed into assisted living. David Gentry explained there is a long,long, long wait for placement.

The Advanced Medical Directive I have given to Dr. Win explains in great detail what the limitations of treatment are as related to homeless shelter systems.Various surgeries which have to be done cannot be done in a homeless shelter and if Dr. Win is unwilling to move towards assisted living or something I will have to find another provider who will or we will have to explain another great waste of taxpayers monies.

I askes Pa Lewis Winslow to move foward with Assisted Living and he is unwilling to consider this option. PA Winslow is suggesting a $4,000 colon exam which has recently been completed in September, 2010.

1. The animus of this possible crime is to duplicate a colon exam which will probably costs $4000.00 which was done last year and does not need to be repeated at this time.

2. Title 18 Sec 371 Conspiracy to Commit An Offense To defraud the United States If two or more persons conspire either to commit any offense against the United States, or to defraud the United States, or any agency thereof in any manner or for any purpose, and one or more of such persons do any act to effect the object of the conspiracy, each shall be fined under this title or imprisoned not more than five years, or both.If, however, the offense, the commission of which is the object of the conspiracy, is a misdemeanor only, the punishment for such conspiracy shall not exceed the maximum punishment provided for such misdemeanor.

This Link 10-2-2012 Othopedic Surgeon Dr. David Allmacher reviewed recent X Ray reports I have moderate Osteoporosis in hip and both knees with various cysts; bone spurs; and damage to bone from loss of cartiledge. Instead of doing surgery the Dr. recommends waiting until damage is so bad I can't stand, walk or climb stairs...

Other medical authorities have recommended the study be done much sooner.

ON 10-4,2012 PA Lewis Winslow explained he had faxed instructions to NORCO for Medicaid to provide new walker which Norco explains on 10-5-2012 has not arrived.

After 2 calls last week that they do have any authorization for a walker the NORCO service representative Morgan calls and says come over and get one. I plan to order the NOVA Get Go Class with basket under the walker.

The sleep study in August 2011 is still valid and it is not needed to repeat a very expensive procedure simply to give Partnership Health Center some additional profits. Cost estimate sleep study about $4,000

If you are going to defraud Medcaid for $8,000 and get caught and charged with a federal crime you will net $1100 a year for each year spent in a federal correctional facility.

1. Since 2009 I have been hospitalized about 15 times from DVT and often treated with Lovenox injections costing about $300.00 a day or $9,000 a month. The Lovenox manufacturer called and explained the medication should be used on a short term basis only because it causes loss of bone density. What is loss of bone density?

2. Orthopedic Surgeon David Allmacher recently explained that loss of bone density means moderate osteoarthritis in my hips, knees. Dr. Allmacher explained I should simply wait around and wait until the bone rots out completely and then come back for surgery. Previous medical providers who explained that surgery in indicated.

3. Medical Malpractice I was asked to leave an assisted living facility in Boise, ID last year because I am a severe fall risk. I am currently living in a homeless shelter walking up and down stairs several times a day with a walker and impaired walking abilities. PS Lewis Winslow explains he can�t understand my need to be in either assisted living or skilled nursing facility as I have been in the past for chronic health issues.

4. Medicaid Fraud: The staff wants to complete medical work I do not believes to be re-done such as Cholesterol check, colonoscopy, and a sleep study this is generally referred to as Medicaid Fraud.

5. On Thursday, October 4th, 2012 the nurse Debbie explained she has forwarded an authorization from PA Lewis Winslow to Norco for a walker-and Norco explained they have not seen or heard from your folks.

Because the services are not complying with my previous instructions I have terminated the services of Partnership Health Center by written letter 10-5-2012 and am withdrawing permission to share medical records with anyone else.

I was in the ER having my counadin checked and this Nurse Linda came in and asked where do you come from and why don't you leave right away? The ER Nursing supervisor explained she would neuter the problem right away-thanks

During my first on only and meeting on 10/23/2012 with Dr. Ravitz the doctor reviewed my extensive medical history and explained he would have no problem moving forward with my medical treatment plan. Rather than follow my the instructions for INR testing once a week for Coumadin the doctor has scheduled the next test on November, 23th, 2012; forgot or neglected to ORDER CPAP machine; didn't move forward with requested treatment during surgeries for MRSA......

Since everything I am attempting to do is dependent on extensions by the POv I have a revised case plan.

During my first and only meeting with Dr. Ravitz the doctor reviewed my extensive medical history and explained he would have no problem moving forward with my medical treatment pln Rather than follow my the instructions for INR testing once a week for Coumadin the doctor has scheduled the next test on November, 23th, 2012. The family of legal actions styled Walters V Social Security...have been closed for 20 years from futher adjudication. The Commissioners Final Determination of 2007 was an out of court settlement which cannot be appealed, modified. or amended The several US Circuit Courts of Appeals and US Supreme Court have declined to permit the matter to be brought up for additional review.

The Advanced Medical Directive has been served on the community for 3 months which outlines what is or is not authorized as viable as medical treatment. Many of the providers are either declining to move forward with treatment or attempting to substitute authorized treatment with something else. I would suspect a question of costs is involved.

Dr. Eichhorn and Nurse Gina S do excellent minor surgery on small abcess on buttocks and keep it from getting larger.

Since I have as Dr. Ghee explained an antibiotic resistant form of MRSA it comes as no great surprise that a large number of the guest and staff are getting sick. Whether the problem comes from me or the bed bugs is open to speculation.

Being hospitalized several times a year at a costs of $25,000 a shot would suggest assisted living is a much cheaper solution than the government eating $75,000 a year in assorted hospital bills

When I asked Dave if he wanted my medical records he indicated he did not need them and I have already provided the a list of medical concerns including risk of stroke or PE from chronic DVT. His assessment of my medical issues was limited to osteoarthritis and did not consider other medical conditions including numerous hospitalizatons for DVT; chronic MRSA and C.diff infections....

The client John Buchanan was admitted to medical dorm of Poverello House in November, 2012 with a terminal illness which his doctor indicates will let him live 6 months. Johns doctor prescribed his admission to hospice.

John according to him self is a drug user and occassional dealer

According to statments made by John Buchanan the Partnership medical team did not provide him with oxygen for lung illness; nor put him in hospice, and provide other treatment prescribed by his previous doctor. His social worker explained his medical treatment was being blocked by the Executive Director of the Poverllo House who John apparently has never met.

Why would someone want to cause the death and suffering of a person who is dying to no apparent reason?

In view of the fact the shelter did not want John to die on their property under these circumstances lacking adequate medical treatment-a decison to give John a bus ticket back to Knoxivlle, Tennessee was made to drop him on his realatives.

1. This event is described as a calculated attempt to deny the patient adequate medical treatment with the intent to cause death or serious injury

NOW COMES the Plaintiff Pro Se Chris Walters before Honorable US District Court to give Notice that Chris Walters has served a true and correct copy of the Advanced Medical Directive on all the parties cited below and is moving out of the State of Montana for medical treatment to wit:

1. The Partnership Health Center of Missoula, Montana was able to successfully treat Chris Walters life threatening medical condition for deep vein thrombosis however further use of medication Coumadin was not possible where medical providers were unable to schedule required weekly blood checks.

2. For 4 months the Primary Care Physician Dr. Eric Ravitz of Blue Mountain Clinic and others were unable for to sign an ORDER for Chris Walters to receive CPAP machine for what medical authorities describe as a threat of respiratory and cardiac failure due to severe sleep Apnea.

3. The letter from Blue Mountain Clinic to Chris Walters of November 14th, 2012 explained Chris Walters should seek admission at Hillside Health Care by calling Kaylee (251-5100) and it is not known if this is a legitimate referral or another sham from Dr. Ravitz.

4. St . Patrick Hospital has successfully performed 4 surgeries in the past several months but none of the Doctors have been able to move forward with installation of PIC line for chronic MRSA infection which has required 100 doses of antibiotic over the last 15 years.

5. Dr. David Allmacher diagnosed moderate osteoarthritis in knees and hip and does not recommend surgery at this time but recommended letting bone deteriorate until such time as Chris Walters is unable to walk or stand while other medical authorities in other states have previously recommended surgery.

6. Chris Walters has been defined as a severe fall risk and needs to live in an facility such as assisted living where the building has grab bars on the walls, showers, and toilet and might question the wisdom of continued residence at the Poverello house where Chris Walters has to climb up and down a flight of stairs daily with a walker.

7. On Monday November 26th, 2012 Chris Walters met with Regional Program Director Dave Gentry of Senior & Long Term Care Division of Montana Department of Public Health and Human Services who described the assisted living options as very limited because Montana is a small state with a limited budget and program limitations.

8. Dave Gentry indicated that the decision to deny Chris Walters application for assisted living was solely based on moderate osteoarthritis and not on other medical problems.

9. In April, 2012 DSHS Patience Jones Social Worker 3 ( 360-533-9245)of Aberdeen, Washington had determined Chris Walters was eligible to move into assisted living Emeritus at Harbour Pointe Shores, in Ocean Shores, WA; however the Primary Care Physician apparently neglected to sign the admission ORDER.

As the economy slows down and various states begin having trouble paying for expensive medical treatments it might be in the interest of all the parties if Chris Walters moves to another State wish a larger population such as Washington. In the course of a year it is not uncommon for Chris Walters to be hospitalized 3-6 times for treatment of deep vein thrombosis with an average hospital bill in excess of $24,000. When Chris Walters has to receive twice daily injections of special blood thinners the costs can exceed $9,000.00 a month. It appear from years of experience that such services are better absorbed by States with a larger population base such as North Carolina, Washington, �.

Title 18 USC 1701 Obstruction of Mail Generally Whoever takes any letter, postal card, or package out of any post office or any authorized depository for mail matter, or from any letter or mail carrier, or which has been in any post office or authorized depository, or in the custody of any letter or mail carrier, before it has been delivered to the person to whom it was directed, with design to obstruct the correspondence, or to pry into the business or secrets of another, or opens, secretes, embezzles, or destroys the same, shall be fined under this title or imprisoned not more than five years, or both.

7. Deprivation of rights under color of law Whoever, under color of any law, statute, ordinance, regulation, or custom, willfully subjects any person in any State, Territory, Commonwealth, Possession, or District to the deprivation of any rights, privileges, or immunities secured or protected by the Constitution or laws of the United States, or to different punishments, pains, or penalties, on account of such person being an alien, or by reason of his color, or race, than are prescribed for the punishment of citizens, shall be fined under this title or imprisoned not more than one year, or both; and if bodily injury results from the acts committed in violation of this section or if such acts include the use, attempted use, or threatened use of a dangerous weapon, explosives, or fire, shall be fined under this title or imprisoned not more than ten years, or both; and if death results from the acts committed in violation of this section or if such acts include kidnapping or an attempt to kidnap, aggravated sexual abuse, or an attempt to commit aggravated sexual abuse, or an attempt to kill, shall be fined under this title, or imprisoned for any term of years or for life, or both, or may be sentenced to death.
