You are looking at part of Exhibit C a United States source document submitted as Evidence and Testimony to the several committees of the United States Congress since 1986. The survey data is occassionally used for creation of federal statutes; considering possible improvements in operation of federal programs; and study of operational field impediments. Because of the Separation of Powers found in US Constitution and various Rules of Congress it not possible to serve summons, subponeas; or other court process on Capitol Hill and persons attempting to can be detained and arrested by Capitol Police or otherwise sanctioned. The Court is asked to establish jurisdiction where numerous ongoing request and demands to challenge the Rule of Law have created questions as to the constitutionality of several US Statutes which is actionable pursuant to Title 28 USC 1331 Federal Question and the Court and Defendants are further asked to consider that ongoing attempts by 3rd parties to empower laws and statutes which directly challenge the US Government are actionable under Title 18 USC 115 Treason, Sedition, and Insurrection�.

Since 1997 questions relating to 42 USC Chapter 7 Social Security Act have been adjudicated and the 3 US Circuit Courts of Appeals (Exhibit A) have closed further questions; discussions, interpleaders, and other legal processes until the Social Security Commissioner exercises his rights pursuant to Title 42 USC 405(g)(H) Judicial Review.

In 1997 the Honorable US District Court Judge Fred Biery issued his Find and Order in the USDC WDT in Walters v Miller and Crownover CA: SA-97-CA-1313 at the request of the Social Security Commissioner that Chris Walters can interact with the Social Security 6 times as provided by statute as cited:

The Commissioner of Social Security Michael Asture made an admission of fact and law that Chris Walters was disabled when the question was at bar in Walters V Asture USDC, NM Case #: 1:07-cv-00257-JCH-RLP the Honorable Judge Judith Herrera Presiding. Subsequent attempts by the Social Security Administrations own staff to over rule the Commissioner and Order of the Court were Quashed by the Honorable Judge Robert Scott C080380 USDC NM. Both Courts ruled the Cause well pleaded and closed from further review except as provided by Title 42 USC 405(g)(H) Judicial Review.

Exhibit B: Since the question at law were created in 1997 Chris Walters has been able to document and catalogue about 300 separate prosecutable violation of Title 18 CRIMES which have been successfully removed to the several Committees of Congress as cited:

Exhibit E: The letter from US Circuit Court of Appeals Nov 1, 2012 which reviewed this question in 2009 expressed on problem with imposition of timely and appropriate sanctions on additional challenges to the Rule of Law. Under Article 1 Section 8 of the US Constitution states: �Reinforcing these powers is Congress�s broad authority �to make all laws which shall be necessary and proper for carrying into execution the foregoing powers, and all other powers vested by this Constitution in the Government of the United States, or in any Department or Officer thereof.�

The United States Congress has established the US Senate Committee on Judiciary Chaired by the Honorable US Senator Patrick Leahy; US Senate Committee Permanent Committee on Investigations Chaired by the Honorable US Senator Carl Levin and the US House Committee on the Judiciary whose vice Chairman is the Honorable US Congressman John Conyers., Jr. for the specific purpose of reviewing problems in the operation of government as contained in the Complaint.

1. Federal Rules of Civil Procedure Rule 56 Summary Judgment cited:

(a) MOTION FOR SUMMARY JUDGMENT OR PARTIAL SUMMARY JUDGMENT A party may move for summary judgment, identifying each claim or defense � or the part of each claim or defense � on which summary judgment is sought. The court shall grant summary judgment if the movant shows that there is no genuine dispute as to any material fact and the movant is entitled to judgment as a matter of law. The court should state on the record the reasons for granting or denying the motion.

2. Citation of Authority Several ORDERS pursuant to Title 42 USC 405(g)(H) Judicial Review:

Exhibit D Citation of Authority: The Responsibility for Administration of the Social Security Administration resides with the Social Security Commissioner and his staff as cited in Title 42 Chapter 7 Social Security Act and neither the Plaintiff Chris Walters nor the US District Court are responsible permitted or required to administer nor operate the Social Security Administration.

4. Exhibit E Service Of Process & Citation of Authority: The responsibility to oversight the Administrative Branch of government and amend US statutes resides with the United States Congress as cited below:

Under Article 1 Section 8 of the US Constitution states: �Reinforcing these powers is Congress�s broad authority �to make all laws which shall be necessary and proper for carrying into execution the foregoing powers, and all other powers vested by this Constitution in the Government of the United States, or in any Department or Officer thereof.�

The United States Congress has established the US Senate Committee on Judiciary Chaired by the Honorable US Senator Patrick Leahy; US Senate Committee Permanent Committee on Investigations Chaired by the Honorable US Senator Carl Levin and the US House Committee on the Judiciary whose vice Chairman is the Honorable US Congressman John Conyers., Jr. for the specific purpose of reviewing problems in the operation of government as contained in the Complaint.

The US Congress has gone on to create and empower the Government Accountability Office and created such statutes as Title 5 Part 1 Chapter 8 Congressional Review of Agency Rulemaking and Title 2 USC Sec. 190d. Legislative review by standing Committees of the Senate and the House of Representatives to empower their right of review.

5. While the Plaintiff Chris Walters has a clear cut constitutional right to petition the government for redress of grievance neither the Plaintiff nor the Court can Issue a Summons or Capitol Hill nor compel the esteemed members of Congress to perform their duties or for instance defend the US Statutes at Bar.

1. Exhibit D & E Plaintiff Chris Walters has extensively petitioned the Commissioner of Social Security and the Congressional Committees throughout 2012 to exercise their lawful authority to address massive problems in the operation of Title 42 USC Chapter 7 Social Security Act.

3. The Court might draw the same conclusion the Plaintiff asserts that realizing the Social Security Program is going broke the government has elected to abandon it�s jurisdictional responsibilities and have the program declared void or unconstitutional.

4. Exhibit F Citation of Authority: Addressed to George Scherger Program Director of the Poverello House in Missoula, Montana explains we can have no further discussions or review of Chris Walters Social Security benefits, case history, or other aspects.

5. The first question is asked is how can Chris Walters of the staff of a nonprofit agency vend, dispense or practice any type of federal law without being members of the Federal Bar and being subject to Sanctions pursuant to Title 18 USC 402 Contempt?

6. As the Social Security Commissioner has already secured several ORDERS prohibiting further discussions of Chris Walters SSI claim why won�t the various Court prosecute Chris Walters and the staff of the Poverello House for violation of Title 18 USC 1509 Obstruction of Court ORDERS?

7. The question of the constitutionality of Title 42 USC Chapter 7 Social Security Act is brought to bar by asking how anyone can practice, vend, or dispense federal law on the property of a church without violation of 1st Amendment separation of church/state?

8. Exhibit G: Dr. Eric Ravitz the primary care physician responsible under Medicaid to provide Chris Walters medical treatment is apparently refusing to move forward with Chris Walters medical treatment of suggestion for treatment of MRSA with a PIC line after 3 recent surgeries for infections.

9. The Court is asked to consider that the refusal of the Medicaid provider to provide adequate and effective medical treatment is a challenge to US Supreme Court ruling in Theresa Shiavo-Schindler v Michael Schiavo where patients can decide what type of medical treatment is or is not appropriate as a matter of personal choice.

10. Statement of Fact: On or about 4PM on 10-26-2012 Mountain Pacific Foundation (800) 497-8232 a representative did a phone evaluation of Chris Walters request for assisted living and indicated he would receive a written determination within 4 business days which as of November, 12th, 2012 has not been received or enacted.

11. Citation of State Authority: The State of Montana has created a barrier to persons such as Chris Walters being able to access assisted living services without additional review by the Montana Department of Public Health and Human Services utilizing Mountain Pacific Foundation as a contract agent to review client eligibility and require subsequent approval by Missoula Montana.

12. The Court is asked to consider that the State has overstepped it�s bounds by asserting additional case review where none is permitted and challenging federal sovereignty and whether the state statutes in question need to be voided?

13. The Court is asked to consider issuing a Summary Judgment declaring Title 42 USC Chapter 7 Social Security Act void as it violates the enables and empower 3rd party tampering with SSA programs by parties who have no legal standing to practice federal law; it permits churches or non profits to vend, dispense or practice law in violation of lst Amendment, it requires parties to violate provisions of the US Penal Code; participates directly or indirectly in attempts to assassinate it�s clients; challenges the right of Chris Walters to fair hearings and equal protection of the laws; and most importantly because it appears those in a position of authority of administer and oversight the Social Security program have abandoned their responsibilities.
Discussion On Merits of Summary Judgement
The Complaint Docket #1 and this brief clearly show the Social Security Administration operates far outside it�s lawful charter and in fact in challenge to it�s mandated functions in Title 42 USC Chapter 7 Social Security Act. Barring some meritorious appearance and actions by the Defendants or the Social Security Commissioner it is Moved that the provisions of Title 42 USC Chapter 7 Social Security Act be voided and the Court might even acknowledge the tremendous amount of time and effort expended by the US Government over the last 15 years to dispatch it�s obligations.
