I am Appellant Counsel of Record before this US Circuit Court of Appeals, prevailing counsel of record in several question removed to the US Congress; and a Special Defender on Human rights in questions moved to the UN High Commission on Human Rights.

During the last several months several US Marshals, FBI Agents and apparently a US District Court Judge had asked if Plaintiff Exhibit C constituted a threat directed to Officers; Agents; and Employees of the Government or Courts

As you probably recall the Bush Administration was involved in a war in Iraq, Afghanistan, killed maybe half million residents of that region most without trial, actively supported imprisonment and torture of alleged terrorist without trial; summary execution; direct military intervention. Because a large part of Plaintiff Exhibit C was created during the Bush Administration the document closely followed established US Government policies of that era to the letter of the law concerning possible sanctions of US Government persons engaged in violations of the International Law. It is important to bear in mind that threats are different from sanctions which are recognized processes of law occasionally exercised under color of authority of law.

When the Obama Administration came into power and began changing policies I began editing Plaintiff Exhibit C to follow the current Administrations policies as closely as possible in matters of policy and law. The family of actions your deputies expressed interest in Walters v Asture have been closed by ORDER of the US Supreme Court (last October); 3 US Circuit Courts of Appeals; and numerous lower courts and any outstanding litigational issues have been reserved by ORDER of the 5th US Circuit Court of Law to the Committees of Congress and an obscure ORGAN of the United Nations

A question of substantial disability or misconduct appears to have occurred in the US District Court Middle District of Carolina the judges assigned to this venue include: James A. Beaty, Jr ~ Chief District Judge Thomas D. Schroeder ~ Distict Judge L. Patrick Auld ~ Magistrate Judge William L. Osteen, Jr. ~ District Judge N. Carlton Tilley, Jr. ~ District Judge P. Trevor Sharp ~ Magistrate Judge Wallace W. Dixon ~ Magistrate Judge.

Title 28 USC § 372. Retirement for disability; substitute judge on failure to retire provides a jurisdictional remedy for both the Circuit Executive and the US Congress to remove; retire; or even censure Judges who are unable to effectively discharge the duties of their offices.

The facts at bar being submitted to the Circuit Executive and Honorable Members of Congress ask if the Judges in this district are unable to effectively administer Justice here in the Middle District of Carolina based on long term gross irregularities in established procedures of law:

1. Exhibit A: Is a recent letter to the Chief Judge H James A Beaty Jr. asking that various concerns in the Middle District of Carolina refrain from further tampering with legal proceedings and rulings which have been concluded in the 5th, 10th, and more recently in the Circuit Court for the District of Columbia.

2. The US Supreme Court, several Circuit Courts and lower courts have previously ruled that changes in Chris Walters SSI benefits can only be heard and considered by a Federal Judge pursuant to Title 42 USC 405 (g)(H) Judicial Review

3. The Honorable US District Court Judge Rosemary Collyer denied the Social Security Administration’s request for a hearing in Walters v Asture 09-0956 after North Carolina had simply cut off Chris Walters benefits without hearing or review.

4. The Chief Judge Sentelle, and Judges Tatel, and Garland of the US Circuit Court of Appeals for the District of Columbia 1:09cv-00956UNA have affirmed Judge Collyer’s decision and ORDERED the ruling held long enough to make sure no appeal could be had.

5. It would appear that the Forsyth County Department of Social Services at 741 North Highland Avenue in Winston Salem, NC 27101 (336-703-3400) had subsequently challenged the ruling of law by withholding Chris Walters’ Medicade Card again to prevent him from receiving medical benefits.

6. Exhibit B: A letter to Former District Attorney Tom Keith suggested his office might quit computer hacking of Chris Walters websites and emails the events being so numerous they helped construct the Antispyware Act of 2005.

7. The District Attorney Tom Keith apparently resigned before being able to respond 100 specific incidents of pillerfage of counsel’s papers an apparent violation of Title 18 USC 242 Deprivation of rights under color of law.

8. The recent seizure of Chris Walters safe deposit box 259 at Bank of America in Las Cruces, NM has been filed before the Honorable Judge Bruce Black as Walters v Lewis 09-811 in the US district Court for New Mexico created a question as to the constitutionality of Title 28 Chapter 33 FBI as it appears counsel’s legal papers are being held for no apparent reason.

9. On 11-19th, 2009 2 US Marshal’s approached Chris Walters and asked if he had threatened US District Court Judge Rosemary Collyer who is the Judge primarily responsible for preserving Chris Walters SSI benefits?

10. The basis for such a nonsensical inquiry was apparently a proposal made to the US House and US Senate Judiciary Committees for expansion of the Circuit Executive Powers to other forms of abuse of the judiciary aside from Judicial Misconduct.

11. The Marshals statement he is conducting a criminal investigation is nonsensical because the US Marshal cannot vend, dispense, or practice law on Capitol Hill and would be subject to arrest by Capitol Police if he even showed up on Capitol Hill without a subpoena.

12. If memory serves the last challenge to the ruling of the 5th US Circuit Court of Appeals ruling in 2004 may have resulted in Chief Judge Wilkins having to step down as Circuit Executive because of North Carolina’s tampering with the ruling of the 3 Judge Court of Appeals ruling.

The laxed Administration of Justice here in the US District Court for the Middle District of Carolina has permitted persons who have no standing to practice any type of federal law to field challenges to the ruling of the US Supreme Court, US Circuit Court of Appeals; and lower courts and created a question as to the Constitutionality of the Social Security Act. Massive abuse of the law enforcement and intelligence assets mandated for use in government efforts against terrorist have been perverted for some petty political agenda and challenge the credibility of Judges who currently sit on the bench in this region. It is no conincidence that Al Quieda the terrorist organization has been based in the Middle District of Carolina for over 30 years finding the atmosphere and lack of respect for law idea for it’s agenda as it’s base of operations at the AT&T University.

The Deputy Marshal who appeared question the appropriateness of an expansion of Congressional or Circuit Court of Appeals power to include summary execution of Judges and other engaged in sedition, treason, or terrorism for instance. The simply fact is that North Carolina was one of the first states to leave the Union during the Civil War and those public officials who engaged in treason were either kill in combat; faced a firing squad; or were hanged on a rope and given their just deserts. Judges, Officers, and Agents primary Oath of allegiance is to the United States of America not someone’s political agenda.

I wanted to thank the Director of the FBI Robert Mueller for his recent question on extra ordinary sanctions proposed for certain extraordinary crimes normally addressed to Federal Prosecutor. The easiest way to deal with gross irregularities in judicial process or challenges to the rule of law might be to expand the jurisdictional authority for review by US Circuit Executives under Title 28 USC 372 372. The scope and purpose of the law would be to speedily end tampering and challenges to the rule of law which US District Court Judges state they lack statutory authority to pursue:

1. Interception of theft of a US Court ORDER would fall into jurisdictional authority for the Circuit Executive to prosecute pursuant to- Title 18 USC 1509 Obstruction Court ORDER

2. Challenges to the ORDER of Federal Courts by persons who have Sworn an Oath of Allegiance to the United States might also be prosecuted by the Circuit Executive pursuant to Title 18 CRIMES aka Sedition

3. Judges or conservators creating fictious conservator ships for the purpose of looting retiree's benefits can also be prosecuted under by Circuit Executive. Title 18 USC 242 Deprivation of rights under color of law.

Given the openness of the Committees and US Department of Justice in dealing with misuse of law enforcement a nd intelligence activities by renegade elements of these communities I can only suggest what President Obama has already stated: "There Will Be Change".

3. Last Week a Deputy US Marshal has approached Mr. Miller and provided privileged medical information in apparent violation of the Federal Privacy Act.

4. Mr. Willis Miller has demanded a forbidden 3rd party hearing on 11-25-2009 at 9 AM to delve into matters the Court have already ruled are not any of his business.

5. A question of violation of Title 18 USC § 1512. Tampering with a witness, victim, or an informant occurred when Mr. Miller indicates Chris Walters will have to attend a disciplinary hearing the following Wednesday December 2nd, 2009.

6. A Judicial Misconduct Complaint has been filed in 4th US Circuit Court of Appeals questioning what right Judges or others have to challenge the ruling of the Case at Bar and an extraordinary question of Impeachment has been tendered in House and Senate Judiciary Committees.

The question involves 3rd party tampering where the 3rd parties attempted to Quash several existing federal Court ORDERS and have apparently seized the December, 2009 SSI check.

2. North Carolina officials have declined to issue Appellant Chris Walters a current Medicade Card for treatment of serious health problems with the expectation that the Appellant might suffer serious harm; injury; or even death.

3. The obstruction of Court ORDER a possible violation of Title 18 USC 1509 Obstruction of Court Order appears part of a well established pattern of activity where the principals have previously obstructed similar ORDERS from US Supreme Court; 5th and 10th US Circuit Court of Appeals.

4. 2 Deputy US Marshals have approached Chris Walters and asked if he send threatening communications to the original trial Judge Rosemary Collyer although no facimilie or original document has been produced and no explanation exist as to why Chris Walters would threaten Judge Collyer who has protected Chris Walters SSI Benefits.

The Court is ask to consider that the ongoing obstruction of process of law and ruling of numerous superior Federal Courts here in the Middle District of Carolina draws into question the Constitutionality of Title 42 USC 7 Social Security Act. The 2 Circuit Executives with jurisdiction are asked to reassign the US Marshal current frivilious investigation of a non existent threat to a federal judge to arrest and apprehension of parties actively engaged in obstruction of Court ORDERS.

Many thanks for your efforts and the offices excellent assistance in restoring my SSI and medicade benefits. Since I anticipate the strong possibility of a move out of North Carolina next month I wanted to explain why this may occur. If you visit my online auditing and case management files:

You will note that the US District Court dispatched a question of a hearing by an Administrative Law Judge as frivilious or unlawful and at the bottom of the page you can see the cost to move to New Mexico to address the question at law costs me between $13,000-$15,000 in costs including moving; legal costs; transportation. At the bottom right hand side of the next page index3.htm you will note legal and associated costs of $1400.00. If you review each subsequent page up to index15.htm you can come to the same conclusion I have that a substantial part of my SSI check is not being used for my support but to defend my SSI claim from what the courts have consistently ruled are unlawful or frivilious legal challenges by persons such as Mr. Miller who are not even members of the federal bar or allowed to practice federal law. In theory I am supposed to be able to ask the Court for $110.00 an hour for Attorney Fees (Cited USDC, SDNY) however all the Courts have thus far declined to permit reasonable attorney fees.

You can see the September, 2009 SSI check which was intercepted in New Mexico and apparently recovered by the Social Security Inspector Generals visiting General Delivery at Las Cruces, New Mexico. If you examine the letter sent to Social Security last month this event caused an overpayment or under payment and a tentative agreement to have the SSA deduct $65.00 a month to redress the matter starting 1/01/2010.

If you follow the drift of what I am explaining I am probably looking at a loss of $40,000 and no end in sight. My experience is that certain states I have lived in such as California, New Mexico, Texas, and particularly North Carolina actively encourage 3rd party tampering in SSI claims. Unless you or someone at Social Security can come up with a better idea there is a strong possibility I will move to another state in January, 2010. I have several places in mind where I wont have to spend most of my SSI check responding to unlawful or frivilious request attempting to tamper with matters the numerous Courts have already deemed closed by ORDER.

I wanted to take some time and commend your SSA Office in Burlington, NC at 2010 S Church Street, Burlington NC (866-613-2737) for their extraordinary efforts to resolve an extraordinary problem. As your staff can see form the enclosures a 3rd party in Winston Salem, NC had attempted to tamper with the SSI claim and Quash a recent ORDER from US Circuit Court of Appeals, in DC (Walters V Asture).

The local office was able to reissue a check the 3rd party either threw away or misplaced; got my Medicade reissues (which Forsyth County declined to do) and got a letter of continued benefits which helped me to file the brief which is attached that the Courts ORDER is being upheld.

My discussion with the case manager is to try and get into one of the Salvation Army shelters where I can pay to stay for an indefinite period of time which costs maybe $300.00 a month which I can afford on my income. Salvation Army facilities which permit clients long term stay and will accommodate disabled persons are believed to exist at Greensboro, NC; Kingsport, TN; and I believe 1 might still exist at Salem, Oregon.

The US Supreme Court is asked to consider that it has broader experience in questions of law; more resources; and broader latitude than a mere Appellant Pro Se or Special Defender on Human Rights that the Court might consider solutions in the interest of fairness and equity which are better suited to the interest of the 350 some odd million citizens Social Security that Title 42 USC Chapter 7 Social Security Act is intended to serve.
