Share House demanded I give up my SSI claim and begin searching for work as a condition for staying at the shelter. When I declined the case manager's request I was given the boot into a major winter storm with the reasonable expectation that the beneficiary of such an act would either die or suffer seriouis bodily injury. The 2nd recommendation for a federal grand jury investigation of Washington State DSHS is made to the US Attorney in Portland, Oregon which appears to have been ignored. Largely a matter of common sense that if a geographic area permits the assassination of federal prosecutors and state level cabinet officers it isn't going to waste court time on me.

I wanted to thank your case manager Lanni Kali for offering to develop a case management plan for employment, ssi, and long term housing. Unfortunately the Social Security Administration has secured a number of exotic ORDERS from several federal courts which places these matters in the hands of the Social Security Appeals Council The Social Security Commissioner has been successful in pleading the exclusive right of the Appeals Council to determine if I am employable or disabled and her rights have thus far been sustained by rulings of Justice Scalia of the US Supeme Court. To avoid additional problems where nonprofit agencies and others are penalized or sanctioned the 5th US Circuit Court issued a final ruling that the matter is closed and cannot be reconsidered by any, group, or organization the matters being removed to Congress. You might say that until the Appeals Council issues its final report we are casual observers on the slow moving bus of government and some of the rulings relate directly to questions asked by Lannie Kali:

1. The proposal for employment was provided to the Social Security Appeals Council in the Appellate document based on the findings of the Washington DSHS and social security medical representative Dr. Eric Strandberg in April, 2006 and is pending review..

Lanni wanted too know if I would give up my employment opportunity with PublishAmerican to seek more gainful work which involves the US Supreme Court doctrine that all employment in the United States is at will and cannot be regulated by any government or process of law-Cite Walters v Askew USDC, SDNY (1976)

I am counsel of record in questions of law removed to the Social Security Appeals Council in the case of Christopher A. Walters SSI 261-90-6357 and have noted the appearance of a 3rd party already ejected by a Social Security Judge for fraud and continued efforts to tamper in possible violation of Title 18 USC 1505. Obstruction of proceedings before departments, agencies, and committees and other statutes:

1. In April of 2006 the Social Security Administrative Law Judge William Herbert in San Antonio, Texas issued his ruling which ejected all of Washington States DSHS and representatives medical findings and efforts apparently as being a fraud, hoax, or sham which are probably best described as a possible violation of Title 18 USC 371 Conspiracy to commit offense or to defraud United States.(*Cited).

2. In 2006 Washington State Auditor Brian Sonntag issued his report and disallowed $6.1 billion of Washington State DSHS repayments from Medicare as fraudulent(**cited).

3. As counsel of record before the Social Security Appeals Council I had specifically asked if the Social Security Administrations representative Washington State DSHS and their doctors could readmitted or rehabilitated and Washington DSHS subsequently declined to participate in completion of their medical findings.

4. Exhibit A-On or about November 16th, 2006 I received written instructions from a nonprofit agency which a contract vendor for Washington DSHS and the US Department of HUD to prepare draft letters to permit their staff to create an 3rd party joiner or interpleader to the Social Security Appeals Council.

5. There is no statute whereby the US Department of HUD; a nonprofit agency; can file briefs or act in a matter of law before the Social Security Appeals Council.

6. A question exist as to whether Share House Case Manager Lannie Kali in demanding Chris Walters disregard his medical providers instructions and legal findings of disability to look for work violated US Supreme Court rulings in Terry Schindler Schiavo V Michael Schiavo that the patient has a well established right to adhere to medical advice of their doctors.

7. A question was asked to Health Department as to whether Share House staff in demanding Chris Walters a person known to transmit communicable diseases work in the Share House kitchen created a serious health care threat to the public.

8. Exhibit B: I served a copy of this legal notice on the Katherine Garrett Share Outreach Program Director 1 (360) 695-7658304 indicating their request is prohibited at the request of the Social Security Administration and prohibited by ORDER of 5th US Circuit Court of Appeals.

9. On Monday 11-27-2006 at a meeting with Katherine Garrett indicated Share House has a 25 year history as a vendor for US Department of HUD has a 25 year history of tampering with clients medical and legal affairs and indicated I was to be denied services at this federally funded facility.

10. A question exist as to whether the Share House violated Title 18 USC 242 Deprivation of rights under color of law by denying Chris Walters access to the federally funded program and leaving him out in a winter storm with the expectation that he would suffer serious physical injury or death.

Investigation By Federal Grand Jury
The report of Brian Sonntag on frauds, hoaxes, and shams which disallowed $6.1 Billion in medicare payments to the Washington State DSHS cites harassment of his staff by DSHS personnel which as I recall are described by Title 18 1511. Obstruction of State or local law enforcement Title 18 1512. Tampering with a witness, victim, or an informant .

The Administrative Law Judge in reviewing the Washington State DSHS files on CD Rom omits their numerous findings and doctors to appear in his official report. The obvious fraud is that DSHS doctors prescribed a clear cut course of medical treatment and then obstructed their own contractual demands for evaluation and treatment as best described as a violation of Title 18 USC 371 Conspiracy to commit offense or to defraud United States.

The subsequent appearance of DSHS and HUD vendor Share House and demands to set aside medical treatment and instructions and findings is an obvious and direct attempt to tamper with the Social Security Appeals Council and violation of Title 18 USC 1505. Obstruction of proceedings before departments, agencies, and committees . In attempting to overstep the ORDER OF THE 5th US Circuit Court of Appeals regarding 3rd party joiners Share House is also culpable to Title 18 USC 402 Contempt. You can see from these files that Chris Walters moved to Winston Salem, North Carolina in In late September, 2009 to attempt to get some minor medical work completed. As you can see from this file the "Christian Ministry" ran Chris out of town. We also got out jollies having the County welfare office deny Chris a medicade card he is entitled to so he can't get a doctor to address his medical work.

As you scroll down the page you may get the same impression we did. Chris is a little slow and didn't understand we here in North Carolina enjoy paying more taxes to support him and have blocked this simple medical work which could have been easily completed by any of the hospitals Chris visited. Despite endless problems several doctors managed to prescribe Lovenox for treatment of Deep Vein Thrombosis which seems to work well as a treatment.

California Takes On Unlawful Conservatorships

The new leader of the much-criticized Oregon State Hospital told a legislative committee on Wednesday that he's confident about fixing flaws at the 127-year-old mental institution in Salem.

"I can assure all of you, all of the problems that exist at Oregon State Hospital are resolvable," Greg Roberts told the House Interim Committee on Human Services. His upbeat message prompted one legislator to express frustration about broken past promises to turn around the troubled hospital.

Rep. Ron Maurer, R-Grants Pass, said Oregonians are fed up with the hospital's woes, which have been documented by a series of critical reports and investigations. "It is, quite frankly, a disaster," he said. Drawing a comparison between Oregon's main mental hospital and the infamous insurance company AIG, Maurer said OSH "is not too big to fail."

At some point, he said, "If it doesn't work, we just close it down and do something new." After the committee meeting, Maurer told the Statesman Journal that he thinks legislative discussions about closing the hospital should occur if serious problems persist. "At some point, someone has to bring that up," he said. "Has anybody ever suggested it? We don't have to have an Oregon State Hospital."

Asked whether closure talks are warranted now, Maurer said: "No, I'm going to give Mr. Roberts the chance to make the changes." Roberts, 59, took the reins of the embattled hospital Monday. "Today is my third day. Everybody seems happy I came back yesterday and today," Roberts told the legislative committee, drawing laughs.

Roberts formerly was the director of the Office of State Hospital Management in New Jersey. Before taking the state hospital job here, he spent his entire 37-year professional career in New Jersey, including stints as chief executive officer at five state psychiatric hospitals. In his Wednesday remarks to the legislative panel, Roberts said he successfully dealt with many of the problems now plaguing OSH during his tenure in New Jersey. He said his initial efforts to turn around the crowded, underperforming hospital in Salem will focus on prioritizing problems that need fixing. He also wants to make sure the hospital sticks with its primary mission providing treatment that helps mentally ill patients recover and return to Oregon communities as soon as possible.

New Landmark Laws Overhaul California's
Troubled Conservatorship System

California's conservatorship system for elderly and dependent adults -- originally designed to protect vulnerable adults from fraud and abuse -- is broken. But help is on the way. On Wednesday, the Governor signed the Omnibus Conservatorship and Guardianship Reform Act of 2006, a landmark package of bills to overhaul California's troubled conservatorship system. The legislative package, comprised of bills I authored, along with those of Senator Debra Bowen (D-Redondo Beach), Senator Liz Figueroa (D-Sunol), and Senator Jack Scott (D-Pasadena), is designed to remedy alarming deficiencies in California's conservatorship system that have led to shocking abuses of California's elderly and most vulnerable.

The system today allows private conservators to get themselves appointed in an inappropriate manner. Some steal or mismanage the money that their conservatees spent a lifetime earning. Most public guardians and probate courts do not have the resources to help. Worst of all, the system provides no place to turn for help. Consider the case of Emmeline Frey. Her private, for-profit conservator hired the conservator's own son, a car salesman, as Ms. Frey's financial advisor. The car salesman squandered $100,000 of Ms. Frey's estate, but still collected his commissions. The court overseeing the conservator did nothing to prevent it.

By significantly enhancing court oversight and requiring licensure of professional conservators, the Omnibus Conservatorship and Guardianship Reform Act of 2006 will protect vulnerable adults like Ms. Frey. AB 1363 (Jones) requires much stronger and more frequent court review and oversight of conservators, along with uniform standards of conduct that conservators must follow, brand new and aggressive training rules for all professionals involved in the system, and a new requirement that Public Guardians take the cases of all those at imminent risk of harm. SB 1550 (Figueroa) creates the Professional Fiduciaries Bureau within the Department of Consumer Affairs to license and regulate professional fiduciaries, including conservators, guardians and trustees.

In addition, SB 1116 (Scott) will remedy some of the problems with the sale of a conservatee's home, and SB 1716 (Bowen) will allow the court to take action when it receives informal reports of abuse and neglect from concerned friends or family members. Not all conservators are abusing the system -- many are doing a good job. But the current system has left elderly and dependent adults at the mercy of those who abuse their position. The Omnibus Conservatorship and Guardianship Reform Act will help ensure that our frail loved ones are protected both from those who seek to abuse them and from a system indifferent to their plight.

A room stacked with the unclaimed remains of patients symbolizes what's wrong with the Oregon State Hospital. Eva York died in a bathtub in 1896 at the Oregon Asylum for the Insane. After an inquest, which absolved the hospital staff of any blame, no one claimed her corpse, so she was buried in the asylum cemetery and forgotten.

Eighteen years later Eva's remains were exhumed, cremated, placed in a copper urn and forgotten all over again. Today the corroding canister containing her ashes sits on a plain pine shelf in what's called the " Cremains Room" at the 122-year-old Salem institution, now known as the Oregon State Hospital. Eva York is one of about 5,000 patients whose cremains are neatly stacked in that stark, lonely room like cans of paint in a well-stocked hardware store. Her story one of the rare stories that can be told, thanks to the inquest into her death makes her a perfect symbol for what's wrong with the way Oregonians treat some of the most frail among us. The 2005 Legislature, which convenes Monday, must address this shameful truth.

The state hospital was a dumping ground in Eva's day, and to some extent it still is today. Even its administrators admit they're housing patients who don't belong there. Wards are overcrowded. Staffing is inadequate. Patients whose psychoses have been stabilized by medication are being warehoused in the hospital for lack of smaller community-based mental health centers that would be far better for them.

These editorials were published between January and September of 2005. They won the 2006 Pulitzer Prize for editorial writing. The grim, sprawling hospital is no place for juveniles, yet Oregon houses about a dozen frightened, troubled kids there. Some of the girls, often prior victims of sexual abuse, pull their mattresses out into hallways to sleep in safe view of staff. During the day, adolescents pass time outdoors in plain view, through concertina and barbed wire, of maximum-security adult patients

These kids are left there, however, because Oregon has no proper facility for them. There's really nowhere else they can go. Out of sight, out of mind. It's an age-old story of neglect for Oregon's most unfortunate. In fact, it was Eva York's story more than a century ago. Today we know far more about Eva than any of her forgotten companions in the Cremains Room. That's because her death led to a story in Salem's Daily Capital Journal on Nov. 25, 1896

Eva was a 36-year-old Marion County woman who probably wasn't even mentally ill. According to the old newspaper clipping, she was an epileptic, confined to the hospital's asylum-era epileptic ward five years before her death. In those days her malady, like depression and alcoholism, was viewed as akin to insanity. Eva died between 2 and 3 p.m. on a Tuesday, "bath day" in the epileptic ward. While left unattended in a tub, she had a seizure and died from it, a coroner ruled. He found no evidence of drowning. An inquest jury declared the hospital to be "in no way responsible." The news account went on to say the hospital telegraphed word of Eva's death to "a brother residing near Hubbard." Her remains, however, were never claimed.

The entire asylum cemetery was exhumed in 1913-14 when the state decided it needed the land. Many of the headstones were unceremoniously dumped on a nearby hilltop. All unclaimed remains, including Eva's, were cremated and stored in a basement. By 1976 that bleak collection of urns exceeded 5,000. That year, in a long overdue act of respect, they were placed underground in a modest memorial on the hospital grounds. But water seeped into the vaults, damaging the copper containers and destroying most of their paper labels. A few years ago, the cash-strapped institution unearthed the urns and stashed them in the Cremains Room, next to the incinerator where all the patients had been cremated.

If Eva York is a symbol of Oregon neglect, the hospital itself its physical hulk is a full-blown metaphor. The tub that she died in is still there, gathering mold and rat droppings in an abandoned wing that's creepier than any haunted house one might imagine. Occupied spaces of the hospital are cheerier only by comparison. They comprise a foreboding, ramshackle collection of additions to the original 1883 structure along with several decrepit satellite buildings, the newest of which is more than a half-century old.

Patients spend their hours locked in jam-packed day rooms connected by long, dreary corridors to their prisonlike sleeping quarters, crammed with more bodies than they were designed for. They gaze out windows c overed with oppressive security screens, and they stare at visitors coming and going on balky, creaky old elevators. No wonder the makers of "One Flew Over the Cuckoo's Nest," the Oscar-winning movie based on Ken Kesey's novel, chose to film it at the Oregon State Hospital. It was a fright 30 years ago, and the place still looks the same today.

Unlike the cinematic "Cuckoo's Nest" villains, however, the administrators and staff at today's Oregon State Hospital aren't the bad guys. They're pretty much doing the best they can with deplorable resources provided by a state with a long history of giving short shrift to its mentally ill. Those running the institution, in fact, say they want change. They also voice support for a fledgling movement in the Legislature to create that change. One man Senate President Peter Courtney, D-Salem lit the flame. Fed up with the state pouring money and crowding patients into the hospital, he engineered a $467,000 emergency appropriation last month to start a process that ought to lead to replacement of Oregon's disgraceful relic.
That emergency money will pay for stopgap measures to relieve overcrowding. It also will launch work on a master plan that will give lawmakers a blueprint for a new, more humane way of caring for these patients. On Monday, when the 2005 Oregon Legislature convenes, all 90 members should mark May 16 on their desk calendars. That's the deadline for presentation of this blueprint. It will likely call for a years-long project requiring tens of millions of dollars to build a smaller, modern hospital and an enlarged network of community mental health centers that would be less costly to operate and more effective at treating patients. Every legislator must commit right now to moving Oregon mental health care out of the dark shadows of its 19th-century roots. And while they're at it, they should spend some money on a suitably dignified memorial for the earthly remains of Eva York and her fellow lost souls in the Cremains Room.
